In document 5635 on resolving financial obligations and land taxes in Ho Chi Minh City, the City People's Committee commented on issues during the time the City has not yet issued a Decision amending and supplementing Decision No. 02/2020/QD-UBND dated January 16, 2020 of the City People's Committee regulating the Land Price List according to Clause 1, Article 257 of the 2024 Land Law as follows:
The People's Committee of Ho Chi Minh City approves the use of the Land Price List issued under the 2013 Land Law as implemented before August 1, 2024 (Land Price List according to Decision No. 02/2020/QD-UBND dated January 16, 2020 of the People's Committee of the City) multiplied (x) by the land price adjustment coefficient according to Decision No. 56/2023/QD-UBND dated December 21, 2023 of the People's Committee of the City to resolve financial obligations and land taxes in the period from August 1, 2024 until the issuance of the Decision amending and supplementing Decision No. 02/2020/QD-UBND regulating the Land Price List.
The Ho Chi Minh City People's Committee assigned the Ho Chi Minh City Tax Department, according to its functions and tasks, to urgently coordinate with the Department of Natural Resources and Environment, the Department of Finance and related units to implement the settlement of outstanding land records arising from August 1. From there, calculate the collection of financial obligations, taxes and other relevant legal regulations (land use fees, land rents, personal income tax from real estate transfers and land revenues).

In a recent urgent document sent to the Ho Chi Minh City People's Committee, the Ho Chi Minh City Tax Department said that from August 1 to 27, the tax authority received a total of 8,808 dossiers. Notably, of these, nearly 3,000 dossiers were in cases where no financial obligations arose but were still being held at the tax authority waiting for the new land price list.
After the meeting with the Ministry of Natural Resources and Environment on September 10, there has been no change from the tax authority despite the conclusion. Accordingly, for 8,808 outstanding tax records arising from August 1, 2024 to present in Ho Chi Minh City, including 5,448 personal income tax records due to real estate transfers and 2,737 records in cases where no financial obligations arise to the State (personal income tax from real estate transfers, registration fees, etc.), 346 records of land use fee collection when recognizing land use rights and 277 records of land use fee collection when changing land use purposes, the tax authority strictly implements the "law application principle" that is, the records received at which time will apply the legal provisions in effect at that time for consideration and settlement.
