Vice Chairman of the Ho Chi Minh City People's Committee Bui Xuan Cuong has just signed and issued Decision 71/2024 regulating the recognized residential land limit for households and individuals used before December 18, 1980; from December 18, 1980 to before October 15, 1993 in Ho Chi Minh City.
According to the decision, Ho Chi Minh City will recognize 4 residential land limits corresponding to 4 areas, specifically: 1.
Districts 1, 3, 4, 5, 6, 7, 8, 10, 11, Go Vap, Binh Thanh, Phu Nhuan, Tan Binh, Tan Phu: No more than 160m2/household, individual.
2.Districts 7, 12, Binh Tan, Thu Duc city and towns of Binh Chanh, Hoc Mon, Cu Chi, Nha Be districts: No more than 200m2/household, individual.
3.Urban development planning areas in communes of Binh Chanh, Hoc Mon, Cu Chi, Nha Be districts: No more than 250m2/household, individual.
4.Can Gio district and the remaining areas in communes of Binh Chanh, Hoc Mon, Cu Chi, Nha Be districts: No more than 300m2/household, individual.
Thus, the 4 recognized residential land limits above are kept the same as the regulations in Decision 18/2016 of the Ho Chi Minh City People's Committee according to the 2013 Land Law.
Previously, according to the 2013 Land Law, the Ho Chi Minh City People's Committee issued Decision No. 18/2016 with general regulations for 2 types of limits.That is the residential land limit assigned to individuals and the recognized residential land limit for households and individuals used before October 15, 1993.According to that decision, there are 4 levels (including 160m2, 200m2, 250m2 and 300m2) corresponding to 4 sub-groups of districts in Ho Chi Minh City.
However, implementing the 2024 Land Law, the Ho Chi Minh City People's Committee, under its authority, issued separate regulations on the land area allocated to individuals and the land area recognized for households and individuals.
On September 30, as reported by Lao Dong Newspaper, the Ho Chi Minh City People's Committee issued a decision regulating the land allocation limit for individuals. According to this decision, the city area has only 3 levels (including 160m2, 200m2 and 250m2) corresponding to 3 sub-groups of areas.The basic difference between the land allocation limit allocated by the State to individuals is that the land is newly allocated to individuals who meet the conditions for allocation according to the 2024 Land Law.
As for residential land recognized, the State recognizes "old" land for households and individuals that have had a long-term use period since before October 15, 1993.
According to regulations, the residential land limit recognized by the State for households and individuals will be used to calculate financial obligations when converting land use purposes to residential land, collect land use tax, compensate and support residential land when the State reclaims land...
As for the residential land limit assigned to individuals, based on the 2024 Land Law, individuals in Ho Chi Minh City who meet the conditions will be assigned residential land at 3 levels depending on the area.
Individuals who are cadres, civil servants, public employees, soldiers, police officers...who have not been allocated residential land or housing; teachers and medical staff working in border and island communes; permanent residents in communes who do not have residential land or housing or have not enjoyed housing support policies...These individuals will be considered by the State for land allocation with land use fees collected.The specific fee level will be decided by the Ho Chi Minh City People's Committee based on the policy applied to these individuals.
