Ho Chi Minh City People's Committee has just issued a Plan to implement Resolution No. 29/2026/QH16 dated April 24, 2026 of the National Assembly on specific mechanisms and policies to handle violations of land law that occur before the 2024 Land Law takes effect and remove difficulties for backlog and prolonged projects.
According to the plan, Ho Chi Minh City will clearly define the tasks and responsibilities of each department, board, sector, People's Committee of wards, communes, special zones and related agencies, in order to ensure the unified and regulated implementation of the Resolution, limiting waste of resources.
The city also organizes a review of the system of documents, guiding the implementation of specific mechanisms; summarizes arising difficulties and obstacles and periodically reports on implementation results.
The Ho Chi Minh City People's Committee assigned the Department of Finance to regularly review and update the list of difficult, problematic, and prolonged projects in the area. The Department is responsible for summarizing, reporting, and proposing solutions to remove obstacles for each project when conditions are met.
The Department of Construction is assigned to review the legal status and conditions for project implementation in the fields of construction, housing, and real estate business. For projects that are entangled in construction permits, acceptance, or contents under management, the Department of Construction advises on handling plans.
The Department of Agriculture and Environment presides over advising on issues of land allocation, land lease, land use purpose conversion, issuance of land use right certificates, determination of land prices and financial obligations regarding land. The Department also guides investors to carry out land procedures, provides information on land of projects and land areas being managed so that departments, branches and localities have a basis for reviewing and guiding.
In the field of planning, the Department of Planning and Architecture is assigned to review the legal status and project implementation conditions; advise on handling plans for projects that still have problems with planning.
People's Committees of wards, communes, and special zones are responsible for reviewing and statistically analyzing projects, works, and land areas that are backlogged or facing difficulties in the area. At the same time, localities coordinate to implement compensation, support, resettlement, and site clearance; handle cases of encroachment and land use for improper purposes.
Localities are also requested to coordinate in verifying the current status, origin and land use situation, project progress, construction status; and promptly resolve reflections, recommendations, complaints, and denunciations related to their authority.
According to a report by the Ho Chi Minh City People's Committee, the City has 1,338 backlog projects, extended with a total area of more than 30,691 hectares, total investment capital of more than 658,000 billion VND.
Before Resolution No. 29/2026/QH16 was issued, Ho Chi Minh City had handled 417 projects.
In the past 3 months, the City has continued to remove obstacles for 233 projects, accounting for more than 25% of the new projects being accepted. Thus, there are still 688 backlog projects that need to be further processed.
