Customers petition to remove obstacles because the project has been suspended for too long

Ho Chi Minh City - Many real estate projects have been suspended for decades because investors no longer have the capacity to implement them, causing customers to directly petition for removal.

After Ho Chi Minh City announced the removal of obstacles for 838 prolonged backlog projects and called on businesses to continue reporting to the Department of Finance, so far many more projects have "asked" to be included in the list. It is worth mentioning that among these, there are a series of projects where owners have lost or absconded or projects are no longer capable of implementation and project buyers themselves have to go to call for help.

For example, in the case of a collective of 372 customers buying land plots at the Bac Rach Chiec Residential Area project, they jointly signed and petitioned the collective to the leaders of Ho Chi Minh City and the Department of Finance to apply a special mechanism according to Resolution 29 of the National Assembly to remove prolonged obstacles at this project.

The project was assigned by the Prime Minister to be implemented from 2001 but has lasted for more than 25 years, going through many inspection conclusions but has not been resolved definitively.The reason is that the project is involved in many violations, Real Estate Joint Stock Company 10 (under Saigon Real Estate Corporation) is the main investor of the project and does not have enough capacity to implement it, causing the project to still not be compensated and infrastructure has not been completed.

Up to now, most customers have paid money, only a few have received land plots to build their own houses, and the rest have not received land or built houses.While the project is abandoned for a long time, the infrastructure is seriously degraded, causing great waste of social resources.Therefore, customers who bought land plots at the project are forced to jointly sign a collective petition to the leaders of the Ho Chi Minh City People's Committee requesting flexible mechanisms to remove obstacles for the project.

Another project, Hong Linh Residential Area in Nha Be commune, Ho Chi Minh City, also lasted 26 years but has not yet been able to complete the legal procedures to issue pink books to customers who have bought land plots, leading to the failure to build houses while they have paid almost the entire contract value.

The Hong Linh project was implemented from the early 2000s, but then many problems arose related to planning, technical infrastructure, financial obligations and land legal procedures. Notably, after 26 years, many land plots at the Hong Linh project have gone through many layers of transactions and handovers from initial capital contribution contracts, making the determination of final rights and conditions for issuing pink books much more complicated.

Recently, Ho Chi Minh City has implemented many drastic solutions such as issuing Plan 34/KH-UBND, Directive 45/CT-UBND and establishing a special working group to review and remove difficulties for backlog projects directly headed by the Chairman of the City People's Committee.

The biggest problem currently is that resources are being "frozen" in projects that have been prolonged for many years, which is very large. Just 838 projects that have been summarized by the Ho Chi Minh City Department of Finance before, have a total land use area of about 17,000 hectares with a total investment capital of about 206,000 billion VND.

Currently, Ho Chi Minh City is continuing to review, statistically, and build a database of backlog projects and works in the area, classifying them by groups and fields for monitoring, assigning, and organizing implementation, ensuring the right people and the right jobs. It is known that after the latest supplementary data collection, 331 more projects have been registered. Ho Chi Minh City aims to complete statistics, classification, and approval of the list of projects and works with problems, and put the city's database system into operation in the second quarter of 2026.

Regarding businesses after being removed, Ho Chi Minh City also requires them to urgently complete legal procedures, focus resources to accelerate construction progress, and soon put projects into operation; must fully fulfill financial obligations to the state to create real economic value.

Enterprises that are dismantled but continue not to implement them thoroughly will be removed from the priority support list and projects will be considered for project recovery according to legal regulations.
