Ho Chi Minh City accelerates removal of prolonged backlog projects

Ho Chi Minh City - Hundreds of stalled real estate projects for many years are being accelerated to remove legal obstacles to unlock land resources.


838 projects have been dismantled

A report from the Ho Chi Minh City People's Committee said that the whole city has 838 projects, projects, and land areas with backlogs and problems. Of which, 54 projects are under the central government's jurisdiction, and 784 projects are under the local government's jurisdiction.

To date, the city has completed removing obstacles and directed the handling of 838/838 projects under handling, reaching a rate of 100%, clearing 17,000 hectares of land and mobilizing more than 206,000 billion VND of social investment capital.

The Ho Chi Minh City Department of Finance has also announced Plan No. 243 of the Ho Chi Minh City People's Committee on continuing to remove difficulties and obstacles for long-standing projects and works in Ho Chi Minh City.

It is known that although the speed of removal is being accelerated, in reality, the number of projects to be handled continues to increase. After Ho Chi Minh City announced the list of 838 backlog projects to be handled, the Ho Chi Minh City Real Estate Association (HoREA) said that in the latest reports, 120 more projects have been registered by businesses on the list to remove obstacles and difficulties because they are long-standing backlog projects in the city.

The list of projects to be handled is still long

According to Mr. Le Hoang Chau - Chairman of the Ho Chi Minh City Real Estate Association (HoREA), many projects are classified as "basically completed and resolved", but still cannot put land into exploitation or complete investment procedures due to existing problems related to land, financial obligations or planning.

For example, in the old Ba Ria - Vung Tau area, although all projects have been put on the dismantling list, 4 projects of Lan Anh One Member Limited Liability Company including Lan Anh 7B, Lan Anh 10, Lan Anh 11 and Lan Anh 12 are still facing prolonged problems, mainly due to slow determination of land use fees or changes in planning.It is known that there are dossiers submitted by businesses from 2021, but after 4-5 years, the determination of financial obligations has not been completed.This has caused cash flow stagnation, large financial costs arising and creating pressure on bad bank debts.

Besides, there are also cases where many projects have had to stop construction for decades and still have no way out.For example, the Saigon Venice social housing project, Binh Loi commune, Ho Chi Minh City, invested by United Nations International Investment Corporation (under CT Group), with an area of more than 63 hectares.From 2019 to now, the project has encountered problems due to the legal review of projects belonging to Lang Le Farm, including the company's project.Up to now, the review process has lasted more than 6 years, city leaders have assigned departments and branches to review and report seven times, but it has not been completed, but only stopped at the establishment of the Lang Le Farm Review Working Group, making the project unable to be implemented.

Or like the high-rise apartment building area of lots 11. A, 11. B, 11. C and 1. E belonging to Dong Tang Long New Urban Area invested by the Joint Stock Corporation for Compensation and Relocation has been approved for investment policy from 2009, and in 2016 it was recognized as the investor and approved for investment with progress to 2020. Currently, the project has completed the necessary legal procedures, and is eligible to submit applications for construction permits and start construction. However, due to the prolonged review process for the land allocation mechanism and implementation method, the project has not yet carried out procedures for land allocation and land use purpose conversion to deploy construction.

Mr. Le Hoang Chau said that this review is an important opportunity to definitively handle backlog projects, unlock land resources and ensure the rights of homebuyers, and at the same time expects the city to build a clearer removal process, specifically identify receiving points, settlement deadlines and responsibilities of each unit. In particular, for projects where investors no longer have the capacity to implement, business leaders die or abscond, the city needs to have a separate handling mechanism, instead of allowing projects to be stalled for a long time as at present.

After removal, if it is still delayed in implementation, the project will be revoked.

Mr. Nguyen Van Duoc, Chairman of Ho Chi Minh City People's Committee, said that the city must completely complete the projects to remove difficulties in the plan in 2026. For businesses, after being removed, they must also urgently complete legal procedures, focus resources to accelerate construction progress, and put projects into operation soon; must fully fulfill financial obligations to the state to create real economic value.

Businesses that are removed but continue to be slow and do not implement them thoroughly will be removed from the priority support list and projects will be considered for project recovery according to legal regulations.
