According to the report of the Ho Chi Minh City People's Committee, as of June 2024, the city has 335 commercial housing projects eligible for issuance of certificates with more than 191,000 units. Of which, 110,000 units have certificates, the remaining 81,000 have not been issued certificates.
Mr. Le Hoang Chau, Chairman of the Ho Chi Minh City Real Estate Association, said that due to legal problems accounting for 70% of the difficulties and problems of projects and real estate and housing project investors, there are 148 real estate, commercial housing and social housing projects in the city that have not been able to complete investment, construction and business procedures or have been suspended. This has resulted in more than 58,000 customers buying houses in projects that have not been granted pink books.
There have been many recommendations to prioritize granting certificates to home buyers who are innocent, vulnerable, and honest. The investor's fault (if any) in complying with the law on investment, construction, business, or mortgaging the project at commercial banks should be handled separately.
And most recently, Vice Chairman of the Ho Chi Minh City People's Committee Bui Xuan Cuong has just signed a plan to implement the work of granting certificates of land use rights and ownership of assets attached to land (pink books) to organizations and individuals in commercial housing development projects in the area.
Accordingly, the plan of the City People's Committee will include three phases. Phase 1: Establish a working group of the City People's Committee; Complete the review, data collection, legal documents collection and publication of statistical results of the list of commercial housing projects in the city. The task of establishing the working group will be completed before October 4, 2024, and the task of reviewing data will be completed before October 23, 2024.
Phase 2: Group and classify difficulties and problems and propose appropriate solutions for each level of authority.
The Department of Natural Resources and Environment is the host unit, coordinating with the members of the working group to complete before November 15, 2024.
As a result of this phase, the working group must come up with a list of commercial housing projects in each specific group of problems and solutions to resolve and remove them.
Phase 3: Implement solutions to remove difficulties and obstacles and resolve the issuance of certificates to home buyers at commercial housing projects.
This phase will implement the solutions proposed in phase 2, chaired by the Department of Natural Resources and Environment. The implementation period is from November 2024 to December 31, 2024.
At the end of this phase, a preliminary report will be made on the implementation of solutions to remove difficulties and obstacles and resolve the issuance of certificates in 2024 and the implementation plan in 2025.
Corresponding to the stages, the Ho Chi Minh City People's Committee also directed the simultaneous implementation of the work of removing difficulties and obstacles in granting certificates at the project through the reflection and recommendations of the project investor and the management board of the housing areas and apartment buildings that have been put into use but have not yet completed the granting of certificates.
In addition, it is necessary to continue implementing solutions to remove 6 groups of problems that have been developed by the Department of Natural Resources and Environment in Plan No. 3981 dated May 11, 2023.
