On September 29, the Ho Chi Minh City People's Council passed a resolution on the list of 54 land plots to be piloted to implement commercial housing projects in the area (phase 1), based on Resolution 171/2024/QH15 dated November 30, 2024 of the National Assembly.
According to the resolution, pilot projects are allowed to be implemented through agreements to receive land use rights or on land areas with land use rights (including agricultural land). This is a new point compared to the current capital regulation requiring businesses to own or receive a transfer of 100% of residential land.
Resolution 171/2024/QH15 of the National Assembly allows real estate business organizations within the pilot scope to receive transfers of rights and change the purpose of use of many different types of land such as agricultural land, non-agricultural land other than residential land, residential land and other land, as long as the land is in accordance with the planning, program and housing development plan of the locality.
Previously, the Ho Chi Minh City People's Committee reviewed and identified 74 land plots with a total area of nearly 1,100 hectares expected to participate in the pilot in 2025.
However, in the first phase, only 54 land plots with an area of over 6 million m2 (over 600 hectares) were approved, of which about 213,000 m2 of rice-growing land will be converted.
For the remaining 20 plots of land, due to not ensuring legality, the Ho Chi Minh City People's Committee was assigned to continue reviewing and completing the documents. If eligible, the city will report specifically to each project, make a list and submit to the City People's Council by the end of October 2025 at the latest.
The Ho Chi Minh City People's Council also assigned the Ho Chi Minh City People's Committee to direct the implementation of projects on the principle of strict compliance with legal regulations on planning, land, investment, housing, real estate business and related regulations. At the same time, the implementation process must be public, transparent, synchronous, feasible and on schedule.
The city emphasizes the priority of promptly handling difficulties and problems; resolutely preventing policy profiteering, loss and waste, as well as preventing the emergence of complicated complaints and disputes.
Within 3 working days from the date of the resolution's approval, the list of pilot land plots will be publicly announced on the electronic information portal of the Ho Chi Minh City People's Committee and the electronic information page of the Department of Agriculture and Environment for people and businesses to easily access.
