On June 12, 2025, the Government issued Decree 151/2025/ND-CP regulating the division of authority of local authorities at 2 levels, decentralization of authority, and delegation in the land sector.
Article 17 of Decree 151/2025/ND-CP stipulates the responsibilities of agencies with land management functions at the commune level from July 1, 2025 as follows:
- The competent land management agency at the commune level is responsible for implementing state management of the contents of the Land Law as follows:
+ Assist the People's Committees at the commune level in land management in localities as prescribed in Clause 5, Article 22 of the Land Law;
+ Organize the preparation of commune-level land use planning and plans as prescribed in Articles 19 and 20 of this Decree;
+ Management and use of information from land records to serve the requirements of state management of land in localities and at the request of citizens, updating land changes in cases of changes under their authority and reflecting violations in land management and use in land records as prescribed in Clause 4, Article 130 of the Land Law;
+ Assist the Chairman of the People's Committee at the commune level in organizing the determination of specific land prices as prescribed in Clause 3, Article 160 of the Land Law;
+ Organize a specialized land inspection as prescribed in Point c, Clause 3, Article 234 of the Land Law;
+ join the Land Dispute mediation council to conduct land dispute mediation as prescribed in Point b, Clause 2, Article 235 of the Land Law;
+ Inspect, urge, and guide the performance of public duties by officials and civil servants; promptly, in accordance with the law, according to authority or recommend competent authorities to resolve complaints, denunciations and recommendations of individuals, organizations and promptly handle violations of the law on land management and use in localities according to authority; detect and propose timely handling of violations of land laws when performing public duties as prescribed in Clauses 2 and 3, Article 241 of the Land Law.
- The competent land management agency at the commune level is responsible for implementing state management of the contents specified in the decrees detailing the implementation of the Land Law as follows:
+ Preside over and coordinate with relevant agencies to appraise the compensation, support and resettlement plan prescribed in Clause 3, Article 3 of Decree 88/2024/ND-CP;
+ Signing the confirmation of the cadastral map extract for registration and issuance of a Certificate of land use rights and ownership of assets attached to land under the authority of the People's Committee at the commune level after being confirmed by the land user and the survey unit;
+ Perform the tasks specified in Point b, Clause 1, Article 24 of Decree No. 101/2024/ND-CP;
+ Providing necessary documents and coordinating with competent state agencies in the process of resolving and agreeing on the administrative unit boundary as prescribed in Clause 2, Article 11 of Decree No. 102/2024/ND-CP;
+ Elect representatives to participate in the Compulsory Counting Committee as prescribed in Clause 1, Article 36 of Decree No. 102/2024/ND-CP;
+ Summary of the need to change the purpose of using rice-growing land, special-use forest land, protective forest land and production forest land to implement investment projects in the area before the time of making a commune-level land use plan for the cases specified in Clause 1, Article 50 of Decree No. 102/2024/ND-CP;
+ Check and complete the dossier to submit to the People's Committee at the commune level for approval of the land use rights auction plan as prescribed in Point a, Clause 4, Article 55 of Decree No. 102/2024/ND-CP;
+ Review the current status of land use within the safety protection corridor of works and areas specified in Clause 2, Article 97 of Decree No. 102/2024/ND-CP;
+ Preside over and coordinate with relevant departments and offices to appraise the combined land use plan and submit it to the People's Committees at the commune level as prescribed in Point b, Clause 4, Article 99 of Decree No. 102/2024/ND-CP;
+ Participate in the Enforcement Committee to implement the decision to resolve land disputes as prescribed in Point b, Clause 7, Article 108 of Decree No. 102/2024/ND-CP.
