Handbook on state management in the land sector regulating registration and issuance of Certificates (red books) for land plots with increased areas due to changes in boundaries compared to the issued Certificate.

Step 1: The candidate must submit the application to one of the following provincial-level agencies: Public Administration Service Center or Land Registration Office or Branch of the Land Registration Office.

When submitting the prescribed documents, the registration fee is selected to submit a copy of the document and present the original for the officer receiving the application to check the comparison or submit the original of the document or submit a notarized or certified copy of the document according to the provisions of the law on notarization and certification; in case of submitting the application online, the submitted document must be digitized from the original or the certified and certified copy of the document.

In case of submitting a copy or digital copy of all documents, when receiving the results of handling administrative procedures, the registered candidate must submit the original documents in the dossier components according to regulations.

In case of confirming changes on the issued Certificate, the registration submits the original of the issued Certificate.

Step 2: The dossier receiving agency implements:

- Check the completeness of the dossier components and issue a dossier receipt and schedule a return of results.

In case the documents are not complete, the documents must be returned with the Supplement and Complete Application Form so that the applicant can register to complete and supplement according to regulations.

- In case the Public Administration Service Center receives the dossier, the dossier shall be transferred to the Land Registration Office or Branch of the Land Registration Office.

Step 3:

a) In case the original land plot has a Certificate, the additional land area due to receiving the transfer of the right to use a part of the land plot that has been granted a Certificate, the Land Registration Office, Branch of the Land Registration Office shall:

- Notify in writing the transferee and post at the headquarters of the People's Committee of the commune where the land is located about the procedures for granting a Certificate to the transferee. In case the address of the transferee is not clear for notification, the notice must be posted 03 times on local mass media, the cost of posting the notice shall be paid by the person requesting the Certificate.

- After 30 days from the date of notification or first posting in local mass media without a request for dispute resolution, the following shall be done:

+ Check the conditions for exercising rights according to the provisions of the Land Law for cases of exercising rights of land users and owners of assets attached to land; in case the conditions for exercising rights are not met, the reasons will be notified and the application will be returned to the registered person.

+ Check and sign the cadastral map measurement piece in case the land user submits the cadastral map measurement piece of the land plot to re-determine the size of the edges and area of the land plot.

+ Record a cadastral map or extract a cadastral map of a land plot for places without a cadastral map or only a cadastral map in the form of a torn or damaged document in cases where the issued Certificate has not used a cadastral map or has not used a cadastral map extract for a land plot and the land user needs to reissue a new Certificate of land use rights, ownership of assets attached to land or is required to reissue a new Certificate of land use rights, ownership of assets attached to land.

- send the Information Transfer Form to determine financial obligations on land according to Form No. 19 issued with Decree No. 151/2025/ND-CP to the tax authority to determine and notify the collection of financial obligations in cases where financial obligations must be fulfilled according to the provisions of law.

- Adjust and update changes in cadastral records and land databases.

- Issuing a new Certificate or confirming changes to the issued Certificate in cases where financial obligations are not fulfilled; handing over the Certificate or sending it to the dossier receiving agency to hand over to the granted person.

In case of having to fulfill financial obligations, perform the tasks specified in this point after receiving a notice from the tax authority on the completion of financial obligations.

In case there is a request for dispute resolution, the parties are instructed to submit the application to the competent state agency for dispute resolution according to regulations.

b) In case the original land plot has a Certificate, the additional land area has not been granted a Certificate:

b1) The Land Registration Office, the Branch of the Land Registration Office shall transfer the dossier to the People's Committee of the commune where the land is located so that the People's Committee of the commune can organize the implementation of the following tasks for the increased land area:

- Confirm the current status of land use with or without houses and construction works; status of land disputes, assets attached to land, stable land use; in case there are no documents on land use rights, the origin of land use will be confirmed.

- Check compliance with the planning in cases where compliance with the planning is required to issue a Certificate.

- Publicly post the inspection results according to Form No. 17 issued with Decree No. 151/2024/ND-CP at the headquarters of the People's Committee at the commune level, residential area where the land is located within 15 days, and at the same time, consider and resolve opinions reflecting on the public content (if any).

- Transfer the dossier with the implementation results in writing to the Land Registration Office, Branch of the Land Registration Office.

b2) The Land Registration Office, Branch of the Land Registration Office shall:

- Check and sign the approval of the cadastral map extract in cases where the land user submits the cadastral map extract of the land plot to re-determine the size of the edges and area of the land plot.

- Record a cadastral map or extract a cadastral map of a land plot for places without a cadastral map or only a cadastral map in the form of a torn or damaged document in cases where the issued Certificate has not used a cadastral map or has not used a cadastral map extract for a land plot and the land user needs to reissue a new Certificate of land use rights, ownership of assets attached to land or is required to reissue a new Certificate of land use rights, ownership of assets attached to land.
