According to the provisions of Article 101 of the 2014 Construction Law on cases where construction permits will be revoked as follows:
a) Construction permits are issued in violation of the law.
b) The investor does not correct the construction in violation of the construction permit within the time limit stated in the document handling the violation as required by the competent state agency.
According to the provisions of Article 64 of Decree 175/2024/ND-CP on the procedure for revoking construction permits, the following takes place:
Step 1: Within 10 days from the date of receipt of the inspection conclusion and inspection document of the state management agency for construction determining the construction permit in the cases specified in Clause 1 of this Article, the competent authority to revoke the construction permit shall issue a decision to revoke the construction permit.
Step 2: The competent authority to revoke the construction permit is responsible for sending the decision to revoke the construction permit to the revoked organization/individual and posting it on its website; at the same time, send information to the People's Committee of the commune where the project is located for public announcement to the People's Committee of the commune within 5 days from the date of issuance of the decision.
Step 3: Organizations and individuals whose construction permits are revoked must return the original construction permit to the agency issuing the decision to revoke the construction permit within 5 days from the date of receipt of the revocation decision.
Step 4: In case the organization or individual whose construction permit is revoked does not submit the construction permit as prescribed, the competent authority for revocation shall issue a decision to cancel the construction permit as prescribed in Clause 2, Article 101 of the 2014 Construction Law and notify the investor and the People's Committee at the commune level where the construction work is located. The decision to cancel the construction permit must be posted on the website of the construction permit revoking agency and integrated on the website of the local Department of Construction.
