The Government Inspectorate (TTCP) has just issued a notice of inspection conclusions on the conversion of land use purposes from production and business to land business and housing construction in the period 2011-2019 of state-owned enterprises and equitized enterprises.
The announcement shows that the implementation of land use conversion from production and business to housing construction of state-owned enterprises and equitized enterprises in the period of 2011-2019 has achieved positive results, land use efficiency has been promoted, meeting part of the housing supply for people.
However, through inspection of 9 land plots/projects in 3 provinces and cities, it was found that in the implementation of land use conversion, land recovery, land allocation, implementation of housing projects, commercial centers, offices, services, relevant agencies and enterprises still have shortcomings, defects and violations.
From the shortcomings and defects inspected, the Government Inspectorate requests the Ministry of Public Security to receive the records and documents for consideration, investigation and handling according to the provisions of law.
That is, for the high-rise housing, office and service project at 120 Hoang Quoc Viet Street (Cau Giay District, Hanoi). The Hanoi People's Committee's approval of land use fees 57,595 billion VND lower than the land use right value approved by the Ministry of Industry and Trade in the enterprise value when equitizing Vietnam Steel Corporation risks reducing the value of the equitized enterprise, leading to a decrease in state budget revenue.
The encroachment of land by some people has lasted for many years, seriously violating the law on land management and use. Up to now, Vietnam Steel Corporation - JSC, Hanoi People's Committee, and relevant agencies have not handled it according to the law, causing a risk of losing land use rights.
Regarding the project of Housing, Office and Commercial Services Complex on Phap Van Street, Hoang Liet Ward, Hoang Mai District, Hanoi, according to the inspection agency, the Hanoi People's Committee reclaimed land, allocated land and allowed Phuong Dong Investment Company Limited to change the purpose of use of over 14,000 m2 of land to implement the project, which is not in accordance with the land use plan approved by the Prime Minister.
The enterprise used 312 apartments for short-term rental and sold them for long-term ownership, which was not in accordance with the approved purpose of use.
At the investment project to build a commercial, service and housing center at 275 Nguyen Trai Street, Thanh Xuan District, Hanoi, the Inspection Agency discovered that the Hanoi People's Committee reclaimed 23,280 square meters of land assigned to Hung Viet Trading Joint Stock Company, without compensating and clearing the site to auction land use rights as prescribed.
Two projects in Hiep Binh Chanh Ward, Thu Duc District, Ho Chi Minh City are mentioned, including: Office, commercial and residential building project at 244 Kha Van Can; Low-rise housing project at 5 Street 22, Quarter 4.
According to TTCP, the Standing Vice Chairman of the Ho Chi Minh City People's Committee signed a document approving the entire change of use purpose of the two above-mentioned land plots by the Materials and Equipment Joint Stock Company, which violated regulations and was not within his authority. This led to violations in approving the value of land use rights.
The Government Inspectorate also recommended that the Prime Minister direct the inspection and handling of responsibilities for collectives and individuals leading the People's Committees of Hanoi and Ho Chi Minh City in different periods related to the above-mentioned shortcomings, shortcomings and violations.
