On July 8, the Hanoi People's Committee issued Document No. 3966/UBND-DT on implementing construction order management in the city.
Accordingly, the City People's Committee assigned the Commune People's Committee to perform the tasks of managing construction order as prescribed in Point b, c, Clause 8, Article 121 of Decree No. 175/2024/ND-CP dated December 30, 2024 and Clause 7, Article 7 of Decree 140/2025/ND-CP dated June 12, 2025 of the Government.
The People's Committee at the commune level is fully responsible before the law and the People's Committee of the city for the management of construction order in the local management area; enhance the role and responsibility of the heads of agencies and units assigned to manage construction order; strengthen public service inspection activities to ensure discipline and administrative discipline, promptly detect and strictly handle units and individuals assigned to perform tasks but are lax in management, lacking a sense of responsibility in performing public duties, leading to violations.
Commune-level People's Committees regularly inspect, monitor, promptly detect, prevent and handle violations when they have just arisen; enforce construction works that violate construction order in the area according to the provisions of law; inspect the conditions for starting construction according to regulations;
At the same time, review the remaining works violating construction order in the management area, continue to handle the violations or recommend competent authorities to handle them according to regulations.
The Department of Construction urges and guides the People's Committees at the commune level in inspecting and handling violations of construction order in the area; organizes regular inspections of the construction order management work of the People's Committees at the commune level, promptly detects, guides and urges the People's Committees at the commune level to overcome shortcomings in the implementation process.
Timely report, advise, and propose to the City People's Committee measures to rectify and overcome shortcomings and limitations in the management of construction order in the city; recommend reviewing the responsibility of the People's Committees at the commune level, organizations and individuals assigned to manage construction order but loose management, lack of sense of responsibility in performing public duties to prevent violations.
The City Police strengthen coordination with the Department of Construction and the People's Committees at the commune level in the management of construction order according to the function of state management of security and order;
Direct the commune-level police to participate in grasping the situation, promptly reporting and reporting to the People's Committees at the same level on violations of construction order; Develop a plan to ensure security, order and safety for forces participating in enforcing construction works that violate construction order;
Organize investigation and handle violations of construction order occurring in the area in accordance with the provisions of the Law on Criminal Procedure; Perform tasks assigned by the Chairman of the People's Committee at the same level in preventing and handling works violating construction order.
