The draft revised Capital Law has been considered and commented on by the National Assembly Standing Committee.
Accordingly, the draft revised Capital Law consists of 9 chapters and 36 articles, reducing 18 articles compared to the current law. The draft Law focuses on delegating authority to the City to decide, creating maximum space for creativity and self-responsibility of the Capital Government; and at the same time strengthening the requirements for power control, inspection, supervision and accountability.
The draft Law also stipulates the principles of application of the Capital Law, in which it assigns the City People's Council (HĐND) the authority to decide on the application in cases where laws and resolutions of the National Assembly issued after the Capital Law takes effect have regulations on preferential or more favorable mechanisms and policies...
Article 12 of the draft Law clearly stipulates urban development and housing. Accordingly, investment in construction, renovation, embellishment, urban reconstruction and housing development in the City must ensure principles such as building urban areas, smart cities, multi-functional, multi-target cities, social housing (NƠXH) areas in a modern, convenient, and synchronous direction with the construction of urban technical infrastructure and social infrastructure.
At the same time, it must be consistent with planning, architectural management regulations, urban design; ensure regulations and standards on construction, fire prevention and fighting; protect cultural, historical, natural, architectural, and landscape heritage;
Ensuring harmony of interests between people, the State, and businesses; prioritizing on-site resettlement; improving urban amenities, improving the living environment and livelihoods for residents in renovated and embellished areas; having priority policies to support organizations and communities to propose and implement urban renovation, embellishment, and reconstruction projects themselves.
The City People's Council stipulates policies, measures, criteria, and conditions for implementing urban renovation, embellishment, and reconstruction projects in the City. At the same time, there is an urban development policy in the TOD area according to the compact urban model associated with stations and railway depots according to the plan.
There are mechanisms and policies on investment, development and housing support in the City; incentives and support for the development of social housing, official housing, housing for resettlement, accommodation and other types of housing.
The use of the City budget to invest in technical infrastructure and essential social infrastructure to serve housing projects according to the plan.
Also according to the draft Law, the City People's Committee has the authority to stipulate the order and procedures for implementing urban renovation, embellishment, and reconstruction projects; stipulate coercive relocation measures to serve urban renovation, embellishment, and reconstruction projects; decide on the list of projects and implementation roadmap.
Decide on the organization and conversion between types of commercial housing, social housing, and housing for resettlement in the City for flexible use, meeting the actual needs of the People.
At the same time, decide on measures to create, manage, and exploit housing to serve the goals of social security and development of the Capital.
