Citizens send questions to the Ministry of Agriculture and Environment with the content:
We respectfully request clarification of the provisions in Clause 5, Article 23 of Decree 101. In case I have a land plot that has been granted a Certificate of Land Use Rights according to the old cadastral map (paper map or old digitized map). Currently, the information that the land plot has changed according to the project to complete the cadastral database on land but I have not been granted a renewal Certificate. So when carrying out procedures for registration of changes (transfer of rights, change of address...), is the competent authority allowed to confirm the content of changes on the issued Certificate or is it mandatory to renew the Certificate?
Answering this content, the Ministry of Agriculture and Environment said:
The content of citizens' reflections is a specific case under the jurisdiction of the locality and needs to be based on archived records, specific regulations issued by the locality according to the jurisdiction of the Land Law to consider and resolve; therefore, the Ministry has no basis to answer. The Ministry would like to state some principles as follows:
According to the provisions of Clause 5, Article 23 of Decree No. 101/2024/ND-CP, one of the cases of registration of land changes, assets attached to land that must be newly granted a Certificate is that there is a "change in all land plot information due to cadastral mapping measurement".
Clause 6, Article 18 of Decree No. 101/2024/ND-CP stipulates "In case the applicant has the need to simultaneously carry out many procedures for registering land and assets attached to land, the procedure handling agencies are responsible for inter-agency coordination with competent authorities for resolution".
According to the provisions in section 12, item II, content A of part V of appendix I attached to Decree No. 151/ND-CP dated June 12, 2025 of the Government stipulating "The time to simultaneously carry out many procedures for registering land and assets attached to land is decided by the Provincial People's Committee but does not exceed the total time to carry out each procedure".
The Ministry of Agriculture and Environment provides information for citizens to know and contact competent authorities in the locality for consideration and settlement in accordance with the law.
