Ms. T.T.T in Hung Yen reported that the commune illegally sold 7 plots of land in 2014. In 2017, the People's Committee completed the 1/500 scale residential planning procedures for 7 plots of land on the area according to the current status of 7 households in use that had built solid houses, and was allowed by the Provincial People's Committee to change the land use purpose for residential planning.
Ms. T asked if it is now possible to instruct people to register for a red book and pay land use fees?
The Ministry of Agriculture and Environment responds to this issue as follows:
The current land law has stipulated the issuance of certificates of land use rights and ownership of assets attached to land to households and individuals who are using land allocated without proper authority in Article 140 of the 2024 Land Law.
The order and procedures for first-time registration of land and assets attached to land for individuals, communities, and households currently using land and the order and procedures for granting certificates of land use rights and ownership of assets attached to land are stipulated in Section II and Section V, Part C, Appendix I issued with Decree No. 151/2025/ND-CP dated June 12, 2025 of the Government regulating the determination of the authority of local authorities at 02 levels, decentralization and delegation in the field of land.
The implementation of financial obligations on land use fees is regulated in Decree No. 103/2024/ND-CP dated July 30, 2024 of the Government.
The Ministry of Agriculture and Environment recommends that people send a report to the Ministry of Finance for answers according to their authority and contact the competent authority in the locality for settlement according to regulations.
