The Ministry of Agriculture and Environment received the opinion of the National Assembly Delegation of Phu Tho province sent by the Ministry of Home Affairs on resolving local difficulties and problems in implementing the 2-level local government model.
The content of the recommendation is as follows: The time for implementing land registration procedures and granting the first Certificate in the Decisions on promulgating the List of administrative procedures in the land sector of competent authorities does not include the time for posting documents (15 days) and the time for determining financial obligations of tax authorities (5 working days) as prescribed in Decree No. 151/2025/ND-CP, so it affects the time for appointing to return results at the dossier receiving department.
Regarding this proposal, the Ministry of Agriculture and Environment said that in Section II, content A, Part V, Appendix I issued with Decree No. 151/2025/ND-CP, it stipulates the time for carrying out procedures for land registration, assets attached to land, issuance of Certificates of land use rights, and ownership of assets attached to land.
In particular, Clause 10, Section II stipulates the time to be calculated from the date of receipt of the dossier to ensure completeness; does not include the time for the competent authority to determine the financial obligations on land, the time to perform the financial obligations of the land user, the time for considering and handling cases of land use violations, the time for appraisal, the time for public posting, posting on mass media, the time for carrying out procedures for dividing inheritance of land use rights and assets attached to land in cases of carrying out procedures for granting Certificates of land use rights and ownership of assets attached to land where the land user or owner of assets attached to land dies before being granted a Certificate.
Therefore, when issuing a dossier receipt and appointing to return results, in addition to complying with the prescribed time for handling administrative procedures, for administrative procedures with regulations on time not included in the procedure settlement time, it is also necessary to specify in the dossier receipt and appointment to return results to make information transparent for the registered person to know, monitor, and implement.
