Breaks and breaks
Labor law clearly stipulates the time for breaks and breaks to protect the health of workers. In Article 58 and Article 64 of Decree 145/2020/ND-CP, workers have the right to a break of at least 30 minutes per shift (for night work, the minimum break time is 45 minutes).
Leave reserved for female workers
Reducing working hours for female employees with children under 12 months old: Article 58 of Decree 145/2020/ND-CP stipulates that female employees with children under 12 months old can reduce their working hours by 1 hour per day if the work is heavy, toxic or has a negative impact on the reproductive function and health of the mother and child. This helps them have more time to take care of their young children without affecting their work.
Menstrual Break: According to Article 137 of the 2019 Labor Code, female employees have the right to take 30 minutes of rest each day during their menstrual period without any reduction in pay. This regulation helps female employees reduce fatigue and pain during menstruation, thereby maintaining health and productivity.
Breastfeeding leave for children under 12 months old: In addition to reduced working hours, female workers are also entitled to 60 minutes of rest each day when raising children under 12 months old. This time allows them to spend time breastfeeding and caring for young children, protecting the development of children in the early stages of life.
Holidays, New Year and paid personal leave
Article 112 of the 2019 Labor Code stipulates paid holidays including:
+ New Year's Day (1 day);
+ Lunar New Year (5 days);
+ Victory Day (1 day);
+ International Labor Day (1 day);
+ National Day (2 days);
+ Hung King's Commemoration Day (1 day).
Employees also have the right to paid personal leave in certain special cases: 3 days off when getting married, 1 day when a child gets married, and 3 days when a parent, spouse, biological child or adopted child passes away.
Leave for treatment of illness or work accident
Article 38 of the 2015 Law on Labor Safety and Hygiene stipulates that employees who have work-related accidents or occupational diseases have the right to take time off work for treatment without having their wages deducted.
Paid annual leave
According to Article 113 and Article 114 of the 2019 Labor Code, employees are entitled to 12 days of leave each year, while employees doing toxic or dangerous work are entitled to 14 to 16 days of leave each year.
Longer leave when unilaterally and illegally terminated contract
According to Article 41 of the 2019 Labor Code, when an employer unilaterally terminates a labor contract illegally, the employee will be entitled to full salary for the days not worked, and will also receive at least 2 additional months' salary according to the labor contract.
Protecting children's rights
One of the special features of the above regulations is the protection of children's rights by ensuring that female workers have time to rest and take care of their children. Benefits such as breaks, breastfeeding breaks and other benefits help female workers take better care of their children's development, protecting the health of both mother and child during the working process.
