The Ministry of Justice is reviewing the Draft Decree regulating the minimum wage developed by the Ministry of Home Affairs before submitting it to the Government for approval.
The draft Decree stipulates the adjustment of the minimum wage to increase by 7.2% compared to the current level to be applied from January 1, 2026.
The draft stipulates the minimum monthly salary levels in 4 regions as follows: Region I is 5,310,000 VND/month, Region II is 4,730,000 VND/month, Region III is 4,140,000 VND/month, Region IV is 3,700,000 VND/month.
The above minimum wage increases from 250,000 VND - 350,000 VND (equivalent to an average of 7.2%) compared to the current minimum wage. The above minimum wage adjustment is about 0.6% higher than the minimum living standard of employees until the end of 2026 to improve employees.
Employers are responsible for organizing a review of agreements in labor contracts, collective labor agreements and regulations and rules of the employer to adjust and supplement accordingly; not to abolish or cut salary regimes when employees work overtime, work at night, compensation in kind and other regimes according to the provisions of labor law.
In particular, the Ministry of Home Affairs proposes for the contents agreed upon, committed in labor contracts, collective labor agreements or other legal agreements that are more beneficial to employees such as:
The salary payment regime for employees working for work or positions required through study and vocational training is at least 7% higher than the minimum wage and the salary payment regime for employees working for work or positions with arduous, toxic, or dangerous working conditions is at least 5% higher;
A job or title with particularly arduous, toxic, or dangerous working conditions must be at least 7% higher than the salary of a job or title with equivalent complexity, working in normal working conditions) than the provisions of this Decree, then continue to be implemented, unless the parties have another agreement.
Ministers, heads of ministerial-level agencies, heads of government agencies, Chairmen of People's Committees of provinces and centrally run cities and employers are responsible for implementing this Decree.
