Youme Law Firm LLC said that, based on Sub-section 6, Section 3 of Official Dispatch 1767/BTC-TCCB in 2025 of the Ministry of Finance, the application for early retirement according to Decree 178, for cadres, civil servants and public employees, including:
1, Submission to competent authorities according to Appendix No.2.
2, List of proposed policies for early retirement and termination of employment according to Appendices No. 03A, 03B, 03C attached to Official Letter 1767/BTC-TCCB in 2025.
3, Minutes of the collective meeting of the unit's leaders and Party committees or opinions of the unit's leaders and Party committees on early retirement and termination of employment for cases proposed for policy (original).
4, Documents for each case of policy application attached to the Documents Statistics Form according to Appendix No. 04, including:
(i) Decision on recruitment of civil servants and public employees (for cases of civil servants and public employees); Labor contracts according to the provisions of labor law before January 15, 2019 or labor contracts subject to policies like civil servants (for cases of employees) (photocopy).
(ii) Decisions/documents on salaries and current salary allowances (including: leadership allowances; seniority allowances beyond the framework; seniority allowances; preferential allowances according to the profession; responsibility allowances according to the profession; allowances for party and socio-political work) (photocopy).
(iii) Social Insurance book or Social Insurance payment process record or Social Insurance payment process comparison form with the stamp and signature of the Social Insurance agency within 03 months from the date of early retirement, termination of employment (copy of notarization).
(iv) Application for early retirement or resignation from work of civil servants, public employees, and workers (in case of voluntary resignation) according to Appendix No. 05 (original).
(v) In addition, based on each specific case, the dossier also has one or a number (but not limited) of the following documents:
- Health records (notarized copies): Individual sick leave application; Documents for non -salary leave of competent agencies to manage civil servants, officials and employees; Payment of sickness allowance from social insurance agencies and the list of leave, time to pay the sick allowance of individuals according to Appendix No. 06. The dossier proves that the disease is on the list of diseases that require long -term treatment in accordance with the Law on Social Insurance 2024.
- Documents proving that due to changes in legal regulations, they have not met the requirements for training qualifications and expertise according to job positions, civil servant rank standards, professional title standards for civil servants, leadership and management title standards according to the regulations of the Party and the State but do not have other suitable job positions for arrangement and cannot arrange training again to standardize expertise and profession (photocopy).
