The company does not arrange work for workers
On September 25, information from the Trade Union Legal Consulting Center (Dong Nai Provincial Labor Federation) said that the unit had just provided legal support to workers, Mr. T.H.H, Trang Dai Ward, Dong Nai Province (who died on June 26, 2025) and the heirs of the rights and obligations of the workers in litigation, won a lawsuit.
According to the Trade Union Legal Consulting Center, the People's Court of Region 1 - Dong Nai has just issued a notice of acceptance of the workers' counter-suit request and rejected all of the company's lawsuit requests. At the trial, the Trial Council determined that the company's lawsuit was unfounded. Accepting the employee's counter-prolaim request, Tien Che Z Steel Company Limited (amata Industrial Park, Dong Nai province) was forced to pay an amount equivalent to the amount of unemployment insurance; unemployment salary during the period of not being assigned work under labor contracts to the employee, with a total amount of 186 million VND.
According to the counter-suit, Mr. T.H.H was recruited to work for Tien Che Z Steel Company Limited ( Amata Industrial Park, Dong Nai province) since September 2007, then signed an indefinite-term labor contract, quality control work, and a salary of nearly 16 million VND/month.
During his working period, Mr. H always completed his tasks, but in July 2021, due to the COVID-19 epidemic situation, the company allowed workers to register "3 on-site", but Mr. H was then in the blocked COVID-19 epidemic area and could not go out to work, and had to follow the Prime Minister's Directive No. 16/CT-TTg on implementing urgent measures to prevent and control the COVID-19 epidemic.
By October 2021, when businesses were operating normally, the company had also arranged for workers to work. However, when Mr. H contacted Mr. H's department head many times, he still only received a notification that he was waiting for the company to have a new notification to work.
On March 23, 2022, because the company had not yet arranged work, Mr. H filed a complaint with the Inspectorate of the Department of Labor - Invalids and Social Affairs of Dong Nai province to request a resolution. On the same day, the company informed Mr. H to work.
On July 25, 2022, Mr. H submitted a resignation letter and the company issued a written response. On September 8, 2022, Mr. H officially quit his job according to the notice period.
However, since quitting her job, the company has not issued a decision to terminate the contract; not paid Mr. H's salary for days not assigned to work; did not resolve Mr. H's sick leave; did not close the social insurance book so that Mr. H could register for unemployment insurance on time according to regulations.
Mr. H submitted a petition to the Labor Advisory Association to request a resolution but to no avail.
Workers who died during the lawsuit, the union continues to support
Unexpectedly, in April 2023, Mr. H received a notice from Tien Che Z Steel Company Limited to file a lawsuit asking Mr. H to compensate 75 million VND because he thought that Mr. H had voluntarily quit his job for a total of 135 days in 2021 and 2022.
Realizing that the lawsuit against Tien Che Z Steel Company Limited for compensation was unfounded, Mr. H did not quit his job on his own but because the company did not arrange work for him after the company completed the "3 on-site" production plan to prevent and control the COVID-19 epidemic.
During the time of not arranging work, the company did not agree to pay Mr. H. At the same time, after Mr. H quit his job, the company did not promptly close and return the social insurance book to Mr. H, leading to Mr. H being unable to register to receive unemployment benefits.
Therefore, Mr. H filed a counter-suit requesting the People's Court of Bien Hoa City (formerly) to consider not accepting all lawsuit requests of Tien Che Z Steel Company Limited and forcing this company to pay the rights to the employees.
According to the Trade Union Legal Consulting Center, in the process of protecting the rights of workers when Mr. H passed away, the staff of the Trade Union Legal Consulting Center continued to represent Mr. H's heirs to demand the legitimate and legal rights of workers.
