According to the Trade Union Legal Consulting Center, Dong Nai Provincial Federation of Labor, from 2024 to present, the center has provided legal support to 84 employees who have claimed social insurance benefits related to Innolux footwear Vietnam Co., Ltd.
To date, 12 cases of 12 workers have been brought to trial and there is a verdict from the People's Court of Thu Duc City (HCMC). The 12 judgments and courts all accepted the workers' requests to file lawsuits, force the company to pay social insurance, close insurance books for workers... The cases of the remaining workers are also being supported by the Trade Union Legal Consulting Center and the Dong Nai Provincial Federation of Labor, demanding legal and legitimate rights according to regulations.
A typical example is the case of Ms. L.T.K.H (34 years old, residing in Xuan Loc district, Dong Nai province), the People's Court of Thu Duc City (HCMC) has just issued a verdict on a dispute over pension insurance, death, illness, maternity, occupational accidents and diseases between plaintiff Ms. L.T.K.H (with legal support from the Trade Union Legal Consulting Center - Dong Nai Provincial Federation of Labor) and defendant Innolux footwear Vietnam Company Limited located in Thu Duc City, Ho Chi Minh City.
According to the content of the case, Ms. H has worked at Innolux footwear Vietnam Co., Ltd. since July 2018, Ms. H's job is as a passing worker, with a salary of more than 6.5 million VND/month for social insurance contributions before quitting her job.
Every month, the company deducts Ms. H's salary to participate in social insurance according to regulations. After Ms. H quit her job, the company only paid social insurance for Ms. H until September 2021. From October 2021 to May 2023, the company only paid unemployment insurance, had not paid social insurance, and had not confirmed the process of participating in social insurance for Ms. H according to the provisions of law. Now, Ms. H requires the company to pay the full insurance and confirm the social insurance payment process for Ms. H.
The court stated that according to the document confirming the social insurance payment process dated July 25, 2023 and the response document No. 10/BHXH dated February 21, 2025 of Xuan Loc District Social Insurance, Dong Nai Province, in Ms. H's case, the company only paid social insurance and unemployment insurance until the end of August 2021. In September 2021, Ms. H quit her job without receiving salary; From October 2021 to May 2023, Ms. H was only paid unemployment insurance by the company, had not paid social insurance and had not confirmed the social insurance payment period. Therefore, the Board of Directors forced the company to pay the full social insurance amount based on the corresponding monthly salary and closed the insurance book for Ms. H according to regulations.
For the above reasons, Thu Duc City People's Court decided to accept the plaintiff's lawsuit, Ms. H, forcing the company to contact the competent social insurance agency to pay the full social insurance to Ms. H.
At the launching ceremony of the Action Month on Labor Safety and Hygiene and Workers' Month in 2025, Director of the Department of Home Affairs Nguyen Huu Dinh called for: Strengthening specialized inspection and examination of the implementation of regulations on labor safety and hygiene, especially in enterprises and production facilities with high risks to promptly detect, rectify and strictly handle violations.
