On June 11, the Trade Union Legal Consulting Center (under the Provincial Federation of Labor) supported the drafting of petitions for 9 employees of Dong Nai Granite Tile Company Limited (Phuoc Tan Ward, Bien Hoa City), sent to the Department of Internal Affairs of Bien Hoa City to propose organizing labor dispute mediation, requesting the company to pay social insurance (SI) for employees during the remaining period, and pay the employees' outstanding wages.
According to the petition of an employee (an unnamed employee), this person has been working at Dong Nai Granite Tile Company Limited since 2015, working as a blacksmith, with a salary of 4,960,000 VND/month for social insurance before leaving work.
After that, the company had a decision to terminate the employment from September 15, 2024 (based on the employee's resignation letter).
During his work at the company, the company deducted monthly salaries from employees to participate in social insurance according to regulations, including 8% social insurance, 1.5% health insurance and 1% unemployment insurance.
After quitting their jobs, workers contacted the company to request payment of 1⁄2 of the remaining September 2024 salary and paid social insurance but it was not resolved.
Employees checking the time of social insurance participation against the social insurance book withdrawal form that the company has returned and knowing that from February 2024 to September 2024, the company only paid unemployment insurance, has not paid social insurance, and has not confirmed the entire process of participating in social insurance for employees according to the provisions of law.
Realizing that the company giving employees a job but not paying the remaining salary, deducting the employees' salary every month to participate in social insurance but not paying to the social insurance agency, not confirming the end of the period of social insurance participation for employees is not in accordance with the provisions of law, so the employee submitted a petition to the competent authority to call for help, requesting Dong Nai Granite Tile Company Limited to pay social insurance for employees from February 2024 to September 2024, confirming the period of social insurance payment for employees according to the law; paying 1⁄2 monthly salary in September 2024 is 2,480,000 VND.
