Trade union persistently pursues insurance debt collection for 151 workers

For the past year and a half, trade union officials of the Ho Chi Minh City Labor Federation have persistently pursued to demand the rights of 151 workers (NLĐ) who were late in paying social insurance by Vinh Thong Production Trading and Service Co., Ltd., Tan Binh Industrial Park, Ho Chi Minh City (Vinh Thong Company) with an amount of nearly 4.8 billion VND.

Businesses repeatedly fail to promise to pay social insurance for employees

Talking to a reporter of Lao Dong Newspaper, Mr. Pham Van Hien - Head of Labor Relations Department of the Ho Chi Minh City Trade Union Employee Counseling and Support Center - informed that recently the center has sent a document to the Civil Judgment Enforcement Department of Ho Chi Minh City and the Civil Judgment Enforcement Department of Area 9, Ho Chi Minh City on supporting to accelerate the progress of judgment enforcement, forcing Vinh Thong Company to fully pay social insurance for 151 employees according to court judgments and decisions.

As Lao Dong Newspaper has reported, Vinh Thong Company owes salaries and is late in paying social insurance for hundreds of company employees. Vinh Thong Company employees have repeatedly stopped working to demand that the company pay salaries and social insurance, but the company has not implemented it. After that, 151 employees (including 14 female employees in maternity) authorized 11 trade union officials under the Ho Chi Minh City Labor Federation to sue, requesting the enterprise to pay nearly 3.1 billion VND in salaries and social insurance with an amount of nearly 4.8 billion VND.

Implementing the authorization of employees, trade union officials of the Ho Chi Minh City Labor Federation sued the company. After a long period of contacting employees to record information, guide procedures and consolidate dossiers for lawsuits, the District 9 People's Court of Ho Chi Minh City issued 19 judgments and 132 decisions recognizing the agreement of the parties (all of which have taken legal effect) forcing Vinh Thong Company to pay all salaries and fully pay social insurance for employees. By April 2026, the company had paid off nearly 3.1 billion VND in outstanding salaries to employees.

Regarding social insurance contributions, Vinh Thong Company initially promised that by February 28th, it would fully pay social insurance for all workers and was recorded in court judgments and decisions, but did not implement it correctly. After that, the company again committed that it would pay fully by June 30th at the latest, but then... broke its promise, causing disadvantage to employees.

Ms. Nguyen Thi Thuy Oanh, formerly a worker of Vinh Thong Company - shared that because Vinh Thong Company did not fully pay social insurance for her, although her child is now over 2 years old, she has not received maternity benefits. Similarly, Ms. Nguyen Thi Kieu Loan also confided that she used to be a worker of Vinh Thong Company and was late in paying social insurance, so when she gave birth in March 2025, she was not paid hospital fees and has not yet received maternity benefits according to regulations. Similarly, many other female employees of Vinh Thong Company also do not receive maternity benefits because the company is late in paying social insurance for employees.

Request to definitively enforce judgments and decisions that have taken legal effect

Faced with that reality, the Ho Chi Minh City Labor Federation has issued a document requesting the Ho Chi Minh City Civil Judgment Enforcement Department to direct the Civil Judgment Enforcement Department of Region 9, Ho Chi Minh City to urgently organize the definitive enforcement of judgments and decisions that have taken legal effect; apply measures to ensure judgment enforcement, measures to enforce judgment enforcement according to the provisions of the Law on Civil Judgment Enforcement for cases where Vinh Thong Company does not voluntarily enforce. At the same time, regularly inspect and urge the progress of judgment enforcement organization to ensure the legitimate rights and interests of employees, thereby contributing to ensuring security and order in Ho Chi Minh City.

Talking to us, bailiff Tran Minh Hieu, who was assigned to enforce the judgment with Vinh Thong Company, said that Ho Chi Minh City Civil Judgment Enforcement has issued a decision to enforce the judgment in the case of Vinh Thong Company. However, currently, Vinh Thong Company is being sued by a bank demanding the recovery of loans with the company's collateral, so the enforcement of the judgment on social insurance for employees has problems.

According to Mr. Pham Van Hien, many times working with functional agencies, the legal representative of the company did not appear but only authorized others to work.

We will continue to follow the case, proposing functional agencies to soon enforce the judgment so that the social insurance benefits of employees are guaranteed" - Mr. Hien said.
