Article 6 of Decree No. 171/2025/ND-CP (effective from July 1, 2025) stipulates that civil servants sent for postgraduate training from the state budget or from the budget of the management agency or unit employing the civil servant must compensate for training costs when falling into one of the following cases:
1. Arbitrarily dropping out of school and quitting work during the training period.
2. Implement disciplinary measures of forced resignation according to regulations.
3. Not being granted a graduation certificate by a training institution.
4. Having completed the training course and been granted a graduation certificate but quitting his job or being disciplined and forced to quit when he has not served the full commitment period prescribed in Clause 3, Article 5 of this Decree.
In addition, Clause 1, Article 8 of the Decree stipulates the conditions for not having to pay compensation as follows:
1. Conditions for not having to pay compensation
a) In case a civil servant is sent for postgraduate training but is not granted a certificate due to a serious illness, is at risk due to natural disasters and epidemics confirmed by competent authorities, he/she shall not have to compensate for training costs.
b) In case a civil servant is sent to undergraduate training by an agency or unit but is then decided by a competent authority to be transferred, rotated, seconded, or transferred to another agency but still belongs to the agency system of the Communist Party of Vietnam, the State, the Vietnam Fatherland Front, and socio-political organizations at the central, provincial, and commune levels, there is no compensation for training costs.
