Pursuant to Point c, Clause 1, Article 31 of the 2025 Law on Employment, civil servants are subject to unemployment insurance.
Pursuant to Clause 1, Article 38 of the 2025 Law on Employment, it is stipulated that:
Benefit level, duration of benefits, time of benefits and documents, procedures for receiving unemployment benefits.
1. The monthly unemployment benefit is equal to 60% of the average monthly salary for unemployment insurance contributions of the 6 most recent months of unemployment insurance contributions before the termination of labor contracts, employment contracts or termination of employment, but not exceeding 5 times the minimum monthly salary by region announced by the Government applied in the last month of unemployment insurance contributions.

Accordingly, the monthly unemployment benefit is equal to 60% of the average monthly salary for unemployment insurance contributions of the 6 most recent months of unemployment insurance contributions before the termination of the employment contract, but not exceeding 5 times the minimum monthly salary by region announced by the Government, applied in the last month of unemployment insurance contributions.
Therefore, from January 1, 2026, the maximum unemployment benefit for civil servants will be based on the minimum wage.
At the same time, according to the Draft Decree regulating the regional minimum wage expected to be applied from January 1, 2026 as follows:

Thus, in case the Draft Decree on regional minimum wages is approved with the proposed regional minimum wage as above, civil servants working in region 4 will receive VND 18,500,000 for the maximum unemployment allowance according to the 2025 Employment Law.
