Waiting for advice to establish an investigation team
On March 3, in an exchange with reporters, a representative of the Department of Labor - Employment - Occupational Safety, Department of Home Affairs of Nghe An province said that they had grasped the information and were waiting for verification results from the Police agency to advise on establishing a labor accident investigation team according to regulations.
According to this representative, after the accident occurred, Thai Thinh General Construction and Consulting Joint Stock Company (the employer) did not report the incident to the Department of Home Affairs as prescribed.
Previously, on the afternoon of January 7, 2026, Mr. Nguyen Vinh Khanh (born in 1965, residing in Truong Vinh ward, Nghe An province), a worker of Thai Thinh General Construction and Consulting Joint Stock Company, had an accident while working at a construction site in Thanh Vinh ward.
During construction, Mr. Khanh was hit by a car with license plate 37C-564. 87, belonging to Khoi Nguyen 68 Construction and Transport Co., Ltd. (address in Lam Thanh commune, Nghe An), driven by driver Quan Vi Tuan.
The victim was taken to the emergency room, operated on but did not survive, and died on January 8, 2026. The forensic examination concluded that the cause of death was severe shock due to trauma causing liver rupture and intestinal contusion.
Family falls into difficult circumstances
Sharing with reporters, Ms. Nguyen Thi Kim Cuc (born in 1974, Mr. Khanh's wife) said that her husband is the main breadwinner, shouldering the family economy. Ms. Cuc works as a freelancer, with unstable income. The family has 3 children, including 1 son and 2 daughters. The son has married, his private life is still full of worries, only enough to take care of his wife and children. The second daughter is in 9th grade, preparing to take the 10th grade entrance exam. The youngest child was born in 2013, currently in 7th grade.
After the accident occurred, the business side temporarily paid 50 million VND in hospital fees and supported 30 million VND to coordinate funeral arrangements. However, up to now, the family said that they have not yet received the investigation conclusion of the case, as well as the investigation conclusion of the labor accident to serve as a basis for resolving benefits according to regulations.
Meanwhile, an official of Nghe An Provincial Police said that the time limit for verifying the case is 4 months; currently, functional agencies are waiting for the results of expertise from specialized agencies to complete the next steps. Representatives of related businesses informed that they are coordinating with functional agencies and will perform their responsibilities according to the conclusion of competent authorities.
Talking to Lao Dong Newspaper reporters about some legal issues of the case, lawyer Tran Hau Dinh - Hanoi Bar Association - said that for fatal labor accidents, in addition to the Police agency verifying signs of crime (if any), the provincial labor management agency must advise on establishing a labor accident investigation team according to the provisions of the 2015 Law on Occupational Safety and Health.
According to the lawyer, the conclusion of the labor accident investigation is the basis for determining the cause, responsibilities of the parties and serving as a basis for resolving benefits for the employee's relatives. Regarding compensation responsibility, if the fault is determined to belong to the vehicle operator, this individual must compensate according to the 2015 Civil Code.
In case the vehicle is owned by the enterprise and is assigned to perform tasks, civil liability may arise for the owner, and at the same time, the labor-using enterprise still has to resolve the occupational accident regime according to regulations.
