According to Article 6 of the 2024 Trade Union Law (effective from July 1, 2025), organizations of employees at enterprises established and operating legally but voluntarily and in accordance with the Charter of Vietnam Trade Unions have the right to join Vietnam Trade Unions. Joining the Vietnam Trade Union is regulated as follows:
Application for joining the Vietnam Trade Union
- Document proposing to join the Vietnam Trade Union;
- Copies of documents showing the legality of the organization of employees at the enterprise;
- Documents showing the organization of employees at enterprises deciding to join the Vietnam Trade Union; the format for approving the decision to join the Vietnam Trade Union is implemented in accordance with the provisions of the law on labor;
- List of signed members voluntarily joining the Vietnam Trade Union;
- Documents and agreements in accordance with the provisions of law relevant to the settlement of rights and obligations of the organization of employees at the enterprise and members of their organization related to the organization of employees at the enterprise;
Procedures for joining the Vietnam Trade Union
The organization of employees at the enterprise sends documents to the provincial, central and equivalent trade unions with competent authority;
When receiving all documents as prescribed, provincial, central and equivalent trade unions with competent authority shall consider and recognize the organization of workers at enterprises joining the Vietnam Trade Union; in case of non-recognition, they must respond in writing and state the reasons.
When recognized as joining the Vietnam Trade Union,:
The organization of workers at the enterprise will of course cease operations as an organization of workers at the enterprise. Provincial and central trade unions and equivalent are responsible for notifying the recognition results to the competent state management agency that issues the registration to revoke the issued registration;
Employees who are members of the organization of employees at voluntary enterprises and are eligible to join the Vietnam Trade Union according to the Vietnam Trade Union Charter will be recognized as union members.
The Vietnam General Confederation of Labor guides the joining of Vietnam Trade Union of organizations of workers at enterprises as prescribed in this Article.
