Supporting workers and union officials to win lawsuits
On the first day of launching Workers' Month 2025 in Dong Nai province (May 24), the Trade Union Legal Consulting Center supported workers, Mr. Quang Tuan (name changed), 41 years old, to protect their rights in court and was declared by the People's Court of Trang Bom district to accept all of Mr. Tuan's lawsuit requests, forcing S.L.F Vietnam Co., Ltd. (Bau Xeo Industrial Park, Trang Bom District) to receive workers back to work under signed labor contracts; pay wages for days when workers are not allowed to work, compensate 2 months of wages; pay social insurance, health insurance, unemployment insurance for workers... with a total amount of more than 750 million VND.
This is a case where employees were consulted and provided with legal support from the Dong Nai Trade Union Legal Consulting Center from the beginning and sent union officials to represent them according to their authority to protect the legitimate rights and interests of employees.
Previously, the Trade Union Legal Consulting Center also supported the employee, Ms. Trang (name changed), residing in Bien Hoa City, to win the lawsuit at the trial with an amount of more than 620 million VND. Ms. Trang said that she started working at a garment company in Bien Hoa 2 Industrial Park, Bien Hoa City in 1995. During her work, she always completed her assigned work well and did not violate discipline.
Notably, since July 2009, she was elected as Chairwoman of the company's grassroots union. But in September 2020, the company announced the termination of her labor contract. Disagreeing with this decision, Ms. Trang asked the Center to file a lawsuit in court to claim her rights.
At the trial at the People's Court of Bien Hoa City in December 2024, the Trial Council accepted the content of the employee's lawsuit and forced the company to compensate for related amounts according to the law with a total amount of more than 620 million VND.
Propaganda on labor laws and the Insurance Law at companies and factories
In addition to directly supporting employees in court, the Trade Union Legal Consulting Center continues to implement solutions to protect employees' rights such as: Strengthening propaganda and free legal consultation for employees.
The Center also sent experienced staff and lawyers to protect the rights of employees, requiring employers to resolve related policies for employees in accordance with legal regulations. In the first quarter of 2025, the Trade Union Legal Consulting Center provided legal support consultations to nearly 600 workers, mainly in-person consultations at the center, via phone and social networks. Consulting on wages, labor contracts, social insurance regimes, occupational accidents, etc.
In addition, the Trade Union Legal Consulting Center also disseminates mobile labor laws to workers in boarding houses, factories, and enterprises about some basic contents of the Labor Code, the Law on Social Insurance and policies and regimes related to employees. Workers can directly discuss and answer questions related to labor, employment, maternity benefits, labor contracts, etc. Thereby, helping workers comply with legal regulations, as well as contributing to building harmonious, stable and progressive labor relations in enterprises.
At the launching ceremony of the Month of Action on Labor Safety and Hygiene and Workers' Month 2025 (September 24), Director of the Department of Home Affairs Nguyen Huu Dinh requested that businesses fully implement the salary, social insurance, health insurance, unemployment insurance and other benefits for employees. At the same time, it is necessary to regularly organize periodic dialogues to listen to and absorb opinions from employees and businesses.
