According to Article 112 of the 2019 Labor Code, employees are entitled to take leave with full pay on the following holidays:
a) New Year's Day: 1 day (January 1st);
b) Lunar New Year: 5 days;
c) Victory Day: 1 day (April 30th);
d) International Labor Day: 1 day (May 1st);
d) National Day: 2 days (September 2 of the Gregorian calendar and 1 day before or after);
e) Hung King's Commemoration Day: 1 day (10th day of the 3rd lunar month).
2. Foreign employees working in Vietnam, in addition to the holidays prescribed in Clause 1 of this Article, are also entitled to 1 day off for their traditional New Year and 1 day off for their country's National Day.
3. Every year, based on actual conditions, the Prime Minister shall decide on specific holidays specified in Point b and Point d, Clause 1 of this Article.
According to Notice 6150/TB-BLDTBXH dated December 3, 2024 of the Ministry of Labor, War Invalids and Social Affairs, civil servants and public employees will have their working days swapped from Friday, May 2, 2025 to Saturday, April 26, 2025. Thus, on the occasion of Victory Day, April 30, and International Labor Day, May 1, 2025, civil servants and public employees will have 5 consecutive days off from Wednesday, April 30, 2025 to Sunday, May 4, 2025 (compensating for Saturday, April 26, 2025).
In addition, civil servants and public employees will have a day off for the National Day holiday in 2025 from Saturday, August 30, 2025 to Tuesday, September 2, 2025. This holiday includes 2 days off for the National Day holiday and 2 days off every week.
Agencies and units that do not have a fixed schedule of Saturday and Sunday every week will base on the specific program and plan of the unit to arrange a suitable schedule of holidays, in accordance with the provisions of law.
For employees not subject to the provisions of Clause 1 of this Notice, the employer decides to choose the option of taking leave for National Day, Victory Day 30.4 and International Labor Day 1.5.2025 as follows:
- For National Day holiday: Tuesday, September 2, 2025 and choose 1 of 2 days: Monday, September 1, 2025 or Wednesday, September 3, 2025.
If the weekly day off coincides with a public holiday as prescribed in Clause 1, Article 112 of the Labor Code, the employee shall be entitled to take a compensatory weekly day off on the next working day as prescribed in Clause 3, Article 111 of the Labor Code.
Employers are encouraged to apply the Lunar New Year holiday, National Day holiday, Victory Day holiday on April 30 and International Labor Day on May 1, 2025 for employees as prescribed for civil servants and public employees.
After the 2025 Lunar New Year holiday, the next holiday will be the Hung Kings' Commemoration Day: 1 day (10th day of the 3rd lunar month). The 10th day of the 3rd lunar month in 2025 is a Monday (7th day of the 4th solar month). Therefore, cadres, civil servants and public employees will have 3 consecutive days off (2 weekly days off and 1 holiday).
