Pursuant to Clause 4, Article 9 of Decree 154/2025/ND-CP, the policy for part-time workers at the commune level is to retire immediately from the implementation of the 2-level local government model according to the provisions of the Law on Organization of Local Government:
Non-professional workers at the commune level specified in Clause 1, Clause 2, Clause 3 of this Article shall not enjoy the policies specified in Articles 6, 7, and 8 of this Decree.
At the same time, part-time workers at the commune level who retire immediately from the implementation of the 2-level local government model according to the provisions of the Law on Organization of Local Government and are arranged as part-time workers in villages and residential groups will not enjoy the policies prescribed in this Decree.
Official Dispatch 12/CV-BCD in 2025 clearly states:
Localities shall base on the practical situation and requirements for implementing the tasks of the political system at the new commune level to temporarily extend the employment of non-professional workers at the commune level until before May 31, 2026.
Therefore, the employment of non-professional workers at the commune level will be temporarily extended until May 31, 2026.
So, if part-time workers at the commune level return to the village to enjoy Article 9 or Article 10 of Decree 154/2025/ND-CP on staff streamlining?
Clause 4, Article 9 of Decree 154/2025/ND-CP states that if a non-professional cadre at the commune level retires immediately from July 1, 2025 and is assigned to work as a non-professional worker in a village or residential group, he/she will not enjoy the policies prescribed in Decree 154/2025/ND-CP.
The issue of arranging non-professional cadres at the commune level when it lasts until May 31, 2026 is stated as follows:
If necessary, the People's Committee at the commune level can arrange and assign them to the title of non-professional workers in villages and residential groups.
Therefore, if a non-professional commune-level cadre retires immediately from July 1, 2025 and is assigned to work as a non-professional cadre in a village or residential group, he/she will not be entitled to Article 9 or Article 10 of Decree 154/2025/ND-CP.
In other words, if the local Party Committee and government at the commune level have a need to use and the non-professional workers at the old commune level wish to continue working, the local Party Committee and government will consider and temporarily arrange them to the position of supporting the work of the political system of the new commune-level administrative unit (party agency, Fatherland Front and socio-political organizations, local government);
Or participate in the positions of non-professional workers in villages and residential groups before May 31, 2026 and continue to receive allowances, regimes and policies issued by the Provincial People's Council.
During this time (ie after July 1, 2025 and before May 31, 2026), if a part-time worker at the commune level quits his/her job, he/she will enjoy the regime and policies according to the provisions of Decree 154/2025/ND-CP.
