Youme Law Firm LLC said that, based on Article 3 of Circular 07/2017/TT-BNV, it is stipulated as follows:
Principles of salary arrangement and salary regime implementation
1. For those working in secret service who are soldiers, the People's Public Security shall implement the principles of salary arrangement and salary regime according to the instructions of the Minister of National Defense and the Minister of Public Security and enjoy the allowance for responsibility for protecting confidentiality and mat ma as prescribed in this Circular.
2. For those working in cryptography who are not soldiers, people's police and those working in other cryptographic organizations:
a) Principles of salary classification:
The person recruited or appointed to work in a key organization belongs to which subject, and for which job is assigned, the salary is arranged according to the regulations for that subject, that job, specifically as follows:
People working in cryptography depend on the job title they are assigned to be classified as basic salary or basic technical professional salary according to the provisions of this Circular.
People working in other key organizations appointed to the civil servant rank or professional title of a civil servant shall have their salary according to that civil servant rank or professional title of the civil servant.
b) Principles for implementing the salary regime:
If a person working in a cryptographic organization changes to work another job in a cryptographic organization, his or her salary will be rearranged in accordance with the new job from the date of transfer to work another job in a cryptographic organization. In case the salary and allowance coefficient for leadership positions (if any) is classified as a new job lower than the salary and allowance coefficient for leadership positions (if any) that has been enjoyed according to the old job, the difference coefficient will be retained; this difference coefficient will be reduced accordingly after each salary increase.
According to the task requirements, the cipher worker is holding the position of leadership that is rotated to hold other leadership titles in the cipher organization that has a lower leadership position allowance, the position of position allowance is held according to the old leadership title. In case the new job is rotated to the rules of salary arrangement by rank or lower title, the old salary is kept (including the position allowance if any) and the regime of raising the salary level as prescribed in the old rank or title.
The salary arrangement, salary allowance regime, and salary increase must comply with the subjects, principles, conditions, and benefits specified in this Circular and other regulations of competent authorities.
Accordingly, the principle of salary arrangement for people working in secret services who are not People's Public Security is specific as follows:
