Youme Law Firm LLC said that on December 31, 2024, the Government issued Decree 178/2024/ND-CP on policies and regimes for cadres, civil servants, public employees, workers and armed forces in implementing the organizational arrangement of the political system.
According to Point b, Article 2 of Decree 178/2024/ND-CP, commune-level cadres and civil servants in agencies, organizations, units and armed forces due to organizational arrangement, and administrative units at all levels are one of the subjects applying Decree 178/2024/ND-CP.
According to Article 5 of Decree 33/2023/ND-CP, commune-level cadres and civil servants include:
(1) Commune-level cadres hold the following positions:
- Secretary, Deputy Secretary of the Party Committee;
- Chairman and Vice Chairman of the People's Council;
- Chairman and Vice Chairman of the People's Committee;
- Chairman of the Vietnam Fatherland Front Committee;
- Secretary of the Ho Chi Minh Communist Youth Union;
- President of the Vietnam Women's Union;
- Chairman of the Vietnam Farmers' Union (applicable to communes, wards and towns with agricultural, forestry, fishery, fishery activities and with the Vietnam Farmers' Union);
- President of the Vietnam Veterans Association.
(2) Commune-level civil servants hold the following positions:
- Commander of the Military Command;
- Office - statistics;
- Land - construction - urban and environment (for wards and towns) or land - agriculture - construction and environment (for communes);
- Finance - accounting;
- Justice - civil status;
- Culture - society.
Thus, commune-level cadres and civil servants with the above titles, if they meet the conditions, are eligible for early retirement according to Decree 178/2024/ND-CP.
