According to Section 2 of Official Dispatch 2034/BNV-TCBC in 2025, the regulations for commune-level administrative units remain the same (not reorganized) as follows:
Commune-level administrative units that remain unchanged (not reorganized) will receive functions and tasks from the district level and receive tasks according to decentralization from the provincial level; at the same time, receive cadres and civil servants from the provincial and district levels along with cadres and civil servants at the commune level to arrange according to the new commune-level government model.
Accordingly, cadres and civil servants expected to work in new communes are all subjects directly affected by the implementation of the organizational arrangement and are subject to Decree 178/2024/ND-CP dated December 31, 2024 (amended and supplemented in Decree 67/2025/ND-CP dated March 15, 2025).
Public service units managed by districts and reorganized to new commune-level administrative units, civil servants and employees working in these public service units are the subjects directly affected by the implementation of the organizational arrangement and are subject to Decree 178/2024/ND-CP dated December 31, 2024 (amended and supplemented in Decree 67/2025/ND-CP dated March 15, 2025).
Public service units managed by districts and converted to commune level management, civil servants and employees working in these public service units are not directly affected by the reorganization of the apparatus and are not subject to Decree 178/2024/ND-CP dated December 31, 2024 (amended and supplemented in Decree 67/2025/ND-CP dated March 15, 2025).
Accordingly, these public service units will streamline the payroll, restructure and improve the quality of the civil servant team, civil servants are subjects of application according to Decree 178/2024/ND-CP dated December 31, 2024 (amended and supplemented in Decree 67/2025/ND-CP dated March 15, 2025), not including civil servants in education and health.
Thus, commune-level administrative units maintain the status quo of receiving cadres and civil servants from provincial and district levels along with commune-level cadres and civil servants to be arranged according to the new commune-level government model.
Cadres and civil servants expected to be assigned to work in new communes are all subjects directly affected by the implementation of the organizational arrangement and are subject to Decree 178/2024/ND-CP.
