Article 6 of Decree No. 45/2025/ND-CP stipulates the head and deputy head of the department and the number of deputy heads of organizations under the department as follows:
1. Head and deputy head of the department
a) The head of the department under the Provincial People's Committee (hereinafter referred to as the Director of the department) appointed by the Chairman of the Provincial People's Committee, responsible before the People's Committee, the Chairman of the Provincial People's Committee and before the law for performing the functions, tasks and powers of the department according to the Working Regulations and assignments of the Provincial People's Committee;
b) The deputy head of a department under the Provincial People's Committee (hereinafter referred to as the Deputy Director of a department) appointed by the Chairman of the Provincial People's Committee at the request of the Director of the department, assisting the Director of the department in performing one or a number of specific tasks assigned by the Director of the department and being responsible before the Director of the department and before the law for performing assigned tasks. When the Department Director is absent, a Deputy Director of the Department is authorized by the Department Director to replace the Department Director in charge of the Department's operations. The Deputy Director of the Department shall not concurrently hold the position of head of an organization or unit under or directly under the Department, except where otherwise provided by law;
c) Number of Deputy Directors of the Department
On average, each department has 3 Deputy Directors. Based on the number of departments established and the total number of Deputy Directors, the Provincial People's Committee shall specifically decide on the number of Deputy Directors for each department accordingly. In particular, Hanoi and Ho Chi Minh City, in addition to the total number of Deputy Directors according to the general average regulations, each city will be increased by no more than 10 Deputy Directors.
2. Number of Deputy Heads of Professional and Technical Departments under the Department
a) Departments under the departments of Hanoi and Ho Chi Minh City with less than 10 civil servant positions, departments under provincial level I with less than 9 civil servant positions and departments under provincial level II and type III with less than 8 civil servant positions are assigned 1 Deputy Head of Department;
b) Departments under departments of Hanoi and Ho Chi Minh City have from 10 to 14 civil servant positions, departments under departments of provincial level I have from 9 to 14 civil servant positions and departments under provincial level II and type III have from 8 to 14 civil servant positions arranged with no more than 2 Deputy Heads of Departments;
c) Departments under the department with 15 or more civil servant positions are arranged with no more than 3 Deputy Heads of Departments.
