The newly issued Decree No. 219/2025/ND-CP of the Government on foreign workers working in Vietnam clearly stipulates the authority to issue, reissue, extend, and revoke labor licenses and certificates of confirmation not subject to issuance of labor licenses.
Specifically, Article 4 of Decree 219: Authority to issue, reissue, extend, revoke labor licenses and certificates not subject to issuance of labor licenses
1. The People's Committee at the provincial level has the authority to issue, reissue, extend, and revoke labor licenses and certificates of confirmation not subject to granting labor licenses for foreign employees working for employers with headquarters, branches, representative offices or business locations in the locality where the foreign employee plans to work.
In case a foreign employee works for an employer in many provinces or centrally run cities, the People's Committee at the provincial level where the employer has its head office has the authority to issue, reissue, extend, revoke the labor license and certificate not subject to issuance of the labor license.
2. The provincial People's Committee decides on decentralization to competent authorities to carry out the issuance, re-issuance, extension, and revocation of labor licenses and certificates not subject to issuance of labor licenses according to the provisions of law.
Article 5 of Decree 219 also stipulates the legalization of consulates and certification of documents
1. Documents in the dossier for granting, re-granting, renewing labor licenses and certificates of confirmation are not subject to granting labor licenses to foreign workers who are from abroad and must legalize consulates, except in cases of exemption from consulatory legalization under international treaties to which the Socialist Republic of Vietnam and related foreign countries are members or in principle, they must be retained or according to the provisions of law.
2. Documents that have been legalized by the Consulate must be translated into Vietnamese and certified in accordance with the provisions of law. In case the document is a copy, it must be certified with the original before being translated into Vietnamese and certified according to the provisions of law.
