Supporting more than 50 workers to claim social insurance benefits
Recently, the Dong Nai City Labor Federation has supported more than 50 workers of Dong Nai Granite Brick Co., Ltd. to sue the People's Court of Region 1 - Dong Nai, requesting the Court to resolve and force the company to pay social insurance for workers for the remaining time. Up to now, after the Court declared victory in the lawsuit, many workers have had their social insurance benefits resolved and found new jobs.
Mr. B.S. D (49 years old, residing in Phuoc Tan ward, Dong Nai city) shared: From 2014, he was recruited to work for Dong Nai Granite Brick Co., Ltd. and in 2024 he quit his job.
At this time, Mr. D contacted to request the company to pay and finalize social insurance, but the company did not resolve it. After that, Mr. D checked the social insurance participation time and compared it with the social insurance book slip that the company had returned to Mr. D and discovered that during the period from May 2024 - September 2024, the company had not paid social insurance for him according to the provisions of law, even though the company deducted Mr. D's salary every month. Mr. D filed a lawsuit with the People's Court of Region 1 - Dong Nai, requesting the Court to resolve it.
Similarly, Mr. H.H.S (55 years old, residing in Long Binh ward, Dong Nai city) said that from February 2024 to September 2024, the company only paid unemployment insurance, has not paid social insurance, and has not fully confirmed the social insurance participation process for Mr. S according to the provisions of law. Mr. S has repeatedly contacted the company to request the company to pay and confirm the social insurance participation process for Mr. S but has not been resolved.
Faced with the large number of workers affected by social insurance benefits, the Dong Nai City Labor Federation promptly directed trade unions at all levels to closely monitor and accompany union members and workers to ensure legitimate and lawful rights. Up to now, among more than 50 workers at Dong Nai Granite Brick Co., Ltd., their rights have been resolved, and some cases are continuing to be supported by the Dong Nai Trade Union.
Continue to accompany workers to demand social insurance benefits
Currently, the Dong Nai Trade Union is continuing to support hundreds of workers whose rights are affected at Austgrow Vietnam Group Co., Ltd. (Trang Dai ward, Dong Nai city) and Bach Thanh Ceramic Tile Co., Ltd. (Nhon Trach 1 Industrial Park, Nhon Trach ward, Dong Nai city). In these 2 cases, the Dong Nai Trade Union has closely protected the rights of workers due to the large number affected.
For Bach Thanh Ceramic Tile Co., Ltd., as of the end of June 2026, the total amount of social insurance, health insurance, unemployment insurance, occupational accident insurance and interest that this company has been late in paying is nearly 4.9 billion VND, affecting 339 employees. To date, more than 160 sets of lawsuits filed with the People's Court of Region 2 - Dong Nai have been supported by the Dong Nai Trade Union to help employees claim social insurance benefits.
For Austgrow Vietnam Group Co., Ltd. (Trang Dai ward, Dong Nai city), according to the list of units that are late in paying social insurance, health insurance, and unemployment insurance, as of June 30, publicly announced by Dong Nai City Social Insurance, this unit has 244 employees, owing 7 months of social insurance with a late payment amount of more than 4 billion VND including: social insurance, health insurance, unemployment insurance, occupational accident and sickness insurance. At this company, there is a case of female worker N.T. T (born in 2005, residing in Tan Trieu ward, Dong Nai city) who has not been processed for the social insurance agency to pay maternity benefits because she has not been finalized her social insurance book.
After the Dong Nai Trade Union and Lao Dong Newspaper intervened, the Dong Nai City Department of Home Affairs conducted mediation. Austgrow Vietnam International Group Co., Ltd. committed to coordinate with the social insurance agency to prepare complete dossiers to resolve maternity benefits for Ms. T before September 15, 2026.
Mr. Vu Ngoc Ha - a labor law expert in Dong Nai City - commented: Businesses that have been slow to pay social insurance in the past have caused great difficulties for workers, causing workers' rights to be "suspended" such as: Not being able to retire, not being able to settle sickness and maternity benefits, workers' rights are disadvantaged. When workers work in other companies, their rights are also affected.
According to the Dong Nai City Labor Federation, the situation of evading and owing social insurance, health insurance, unemployment insurance, labor accident insurance, and vocational insurance of labor-using units in the area still occurs, affecting a series of other benefits for compulsory social insurance participants such as maternity allowances, sickness allowances, labor accident allowances... The Standing Committee of the City Labor Federation directs trade union levels to coordinate with functional agencies to strengthen inspection and supervision, promptly detect and propose handling of this situation.
