Decree 154/2025/ND-CP takes effect from June 16, 2025; replacing Decree 29/2023/ND-CP dated June 3, 2023 of the Government regulating staff streamlining.
The regimes and policies specified in Decree 154/2025/ND-CP are applied to cadres, civil servants and public employees until December 31, 2030, including:
- Early retirement.
- Policy to switch to working in non-performing organizations from the state budget
- Dismissal
Clause 6, Article 13 and Point b, Clause 2, Article 14 of Decree 154/2025/ND-CP stipulate as follows:
In case the streamlining of staff is not carried out in accordance with regulations, it is necessary to recover and remit to the budget the costs of streamlining staff, recover decisions on resolving streamlining staff and arrange for people who are not eligible for streamlining staff to return to work;
Clause 5, Article 12 of Decree 154/2025/ND-CP stipulates:
- When resolving staff streamlining not in accordance with regulations, the head of the agency, organization, or unit directly managing the streamlined object must be responsible for:
- Notify the social insurance agency and relevant agencies to stop paying social insurance benefits and other benefits to staff streamlining subjects that are not in accordance with regulations; transfer to the social insurance agency the amount of funds paid to staff streamlining implementers during the period of enjoying social insurance benefits (salary, social insurance allowance, funds for purchasing health insurance cards);
- Responsible for recovering the money enjoyed from the staff streamlining policy allocated to that subject;
- Pay to people who have implemented staff streamlining the difference between salary and other regimes according to the provisions of law with the social insurance regime they have enjoyed;
- Consider handling the responsibilities of related individuals; and at the same time be responsible according to the provisions of law for improper implementation of regulations on streamlining staff.
Thus, when resolving early retirement not in accordance with regulations, the head of the agency, organization, or unit directly managing the subject of early retirement must be responsible for recovering the staff reduction policy benefits allocated to that subject.
