The Ministry of Home Affairs said that the holiday schedule for the Hung Kings Commemoration Day, April 30 - May 1, is implemented according to the provisions of the Labor Code.

Recently, social networks spread information about changing work schedules to connect the Hung Kings Commemoration Day holiday with the April 30 - May 1 holiday, lasting 9 consecutive days.

Regarding this information, in an exchange with Lao Dong Newspaper, a representative of the Department of Labor Conditions - Department of Employment, Ministry of Home Affairs said that the number of holidays of the above holidays is according to the provisions of the Labor Code, and there is currently no new proposal.

According to the provisions of the 2019 Labor Code, employees are entitled to leave work and receive full salary on holidays and Tet every year.

Article 112 clearly states holidays including: New Year's Day (1 day), Lunar New Year (5 days), Victory Day April 30 (1 day), International Labor Day May 1 (1 day), National Day September 2 (2 days) and Hung Kings Commemoration Day (1 day, March 10 of the lunar calendar).

Workers who are foreigners working in Vietnam, in addition to the above days, are also entitled to 1 more day off for the traditional Tet holiday and 1 day off for their country's National Day.

In addition, Article 111 stipulates that each week employees are entitled to at least 24 consecutive hours of leave. In case the weekly holiday coincides with a holiday or Tet, compensatory leave will be granted on the next working day.

Based on this regulation, the Ministry of Home Affairs has issued a notice on the holiday and Tet holiday schedule for officials, civil servants, public employees and workers during the year.

The Hung Kings Commemoration Day falls on Sunday (April 26th of the solar calendar). Due to coinciding with the weekend holiday, workers get compensatory leave on Monday (April 27th). Including the 2 weekend days, the Hung Kings Commemoration Day holiday lasts 3 days, from Saturday (April 25th) to the end of Monday (April 27th).

The two major holidays of April 30 and May 1 of 2026 fall on Thursday and Friday. For workers who do not have to work Saturdays, the holiday lasts 4 consecutive days, from April 30 to the end of May 3 (including both weekends).

According to the provisions of point a, clause 2, Article 107 of the 2019 Labor Code and clause 1, Article 59 of Decree 145/2020/ND-CP, enterprises wishing to use employees to work overtime on holidays and Tet must have the consent of the employee (except for some cases where the company is assigned to work overtime without the employee's consent as prescribed in Article 108 of the 2019 Labor Code).

Regarding the overtime salary level, according to the provisions of Article 98 of the 2019 Labor Code, employees who work overtime during holidays and Tet during the day are paid at least 300% excluding the holiday salary for employees receiving daily wages.

Workers going to work on holidays and Tet holidays are paid a salary of at least 300% excluding the salary on holidays, Tet holidays, and paid holidays for workers receiving daily wages.

At the same time, if employees work at night and work overtime at night, they will be paid at least 30% of the salary calculated according to the salary unit price, 20% of the salary calculated according to the salary unit price or salary according to the work done during the day of normal working days or weekly holidays or holidays, Tet holidays.
