Article 7. Procedures for permitting activities within the protection of defense works and military zones.
1. The dossier's components include
a) Proposal document according to Form No. 1 in the Appendix to this Decree;
b) Photocopy of the organization's operating license, practice certificate ( card) of an individual, vehicle registration documents;
c) Documents and project records related to activities (if any).
2. On how to submit documents
a) For Special Groups
The application file should be sent through the National Public Service Portal, the Administrative Procedure Information System of the Ministry of National Defense and the Provincial People's Committee (PPC) with national defense works and special forces military zones.
b) For the remaining groups
The application file should be sent via the National Public Service Portal, the Administrative Procedure Information System of the Ministry of National Defense.
c) In case the dossier specified in Point b, Clause 1 of this Article has been digitized and stored in the Information System, national database, and specialized database, the agency, organization, or individual shall provide information in the request document according to Form No. 01 for the competent authority to resolve the exploitation online to resolve administrative procedures.
3. Scope of settlement
a) For Special Groups
Within 7 working days from the date of receipt of valid documents; the Provincial People's Committee shall send a written request and related documents to the Ministry of National Defense, and at the same time send them to the agencies and units under the Ministry of National Defense assigned to manage and protect the national defense works and the Special Forces Military Region through the system of sending and receiving electronic documents of state administrative agencies according to Decision No. 28/2018/QD-TTg dated July 12, 2018 of the Prime Minister.
Within 20 days from the date of receipt of valid documents, the Minister of National Defense shall consider and resolve them.
In case the dossier is incomplete or invalid, within 2 working days, the People's Committee at the provincial level will have a proposal for additional dossier and send it to the agency, organization or individual for request. The time for supplementing documents is not included in the time for handling administrative procedures.
After receiving the request document and related documents, if there is any content that needs to be agreed upon, within 2 working days, the Ministry of National Defense will issue a document to discuss with the Provincial People's Committee about the request documents before submitting them to the competent authority for consideration and decision.
b) For Group I, type A, national military training center and working headquarters of the Ministry of National Defense
Within 15 days from the date of receipt of valid documents, the competent authority of the Ministry of National Defense shall consider and resolve them. In case the dossier is incomplete or invalid, within 3 working days, the dossier receiving agency shall have a proposal for additional dossier and send it to the agency, organization or individual requesting the request. The time for supplementing documents is not included in the time for handling administrative procedures.
c) For Group I: type B, type C; Group II: type A, type C, type D
Within 10 days from the date of receipt of valid documents, the competent authority of the Ministry of National Defense shall consider and resolve them. In case the dossier is incomplete or invalid, within 2 working days, the dossier receiving agency shall have a proposal for additional dossier and send it to the agency, organization or individual requesting the request. The time for supplementing documents is not included in the time for handling administrative procedures.
d) For Group II, type B; Group III: type A, type B, type C
Within 7 working days from the date of receipt of valid documents, the competent authority of the Ministry of National Defense shall consider and resolve them. In case the dossier is incomplete or invalid, within 2 working days, the dossier receiving agency shall have a proposal for additional dossier and send it to the agency, organization or individual requesting the request. The time for supplementing documents is not included in the time for handling administrative procedures.
4. The result of the settlement is a document notifying the operation permission issued in paper and electronic to the requesting agency, organization or individual.
5. The Minister of National Defense decides and decentralizes the authority to decide to allow activities within the protection of defense works and military zones.
