According to the provisions of Clause 1, Article 4 of Decree 73/2024/ND-CP (effective from July 1, 2024), the following 2 subjects in public service units are subject to the bonus regime according to Decree 73:
Civil servants in public service units as prescribed in the Law on Civil Servants 2010 (amended and supplemented in the Law amending and supplementing a number of articles of the Law on Cadres, Civil Servants and the Law on Civil Servants 2019).
People who work under the labor contract regime prescribed in Decree 111/2022/ND-CP on contracts for certain types of work in administrative agencies and public service units are eligible or have an agreement in the labor contract to apply salary classification according to Decree 204/2004/ND-CP on salary regime for cadres, civil servants, public employees and armed forces.
Article 4 of Decree No. 111/2022/ND-CP stipulates the work of performing contracts:
1. Support and service work in administrative agencies and public service units to manage and apply regimes and policies according to the provisions of labor law, civil law and other relevant legal provisions, including:
a) Driver, security guard, except for the cases specified in Clause 2 of this Article;
b) Reception, service; housekeeping; vehicle keeping; maintenance, repair, operation of headquarters, equipment, machinery serving the activities of agencies, organizations, units;
c) Other support and service jobs in the list of support and service positions in administrative agencies and public service units are not identified as civil servants or public employees according to the provisions of law.
Thus, civil servants and people working under labor contracts as prescribed at public hospitals (public service units) are subject to the bonus regime according to Decree 73.
Decree 73/2024/ND-CP does not specifically stipulate the bonus level; but the bonus level according to this decree for each case will be stipulated in the Bonus Regulations of the agency or unit.
The head of a public service unit is responsible for developing the Bonus Regulations of the agency or unit.
