The People's Court (TAND) of Region 1 - Dong Nai recently announced the acceptance of a civil case regarding a collective labor dispute over rights - requesting employers to pay Tet bonuses to employees.
The issues that the plaintiff requests the Court to resolve include: Forcing Tenma (HCM) Vietnam Co., Ltd. to pay Tet bonuses to employees at a level of at least one month's salary in accordance with the provisions of Article 10 of the Collective Labor Agreement that the two parties have signed.
Tenma (HCM) Vietnam Co., Ltd., located at Bien Hoa 2 Industrial Park, Tran Bien ward, Dong Nai province is the defendant.
According to the plaintiff's lawsuit, which is the Executive Committee of the grassroots Trade Union of Tenma (HCM) Vietnam Co., Ltd.: In the content of the collective labor agreement in Article 10, it is stipulated: "Based on the results of production and business activities and annual profits of the company, before the Lunar New Year each year, the company will pay bonuses to all employees who are still working at least equal to 1 month's salary if they work full years".
On December 25, 2025, because they did not see the company announce the Tet bonus level, employees at the company stopped working collectively to request an announcement of the Tet bonus level.
On January 20, 2026, the company's Board of Directors informed the grassroots Trade Union Executive Committee about the Tet bonus level of 0.7 months' salary based on the production and business situation in 2025. The grassroots Trade Union Executive Committee requested the company to reconsider the bonus level according to the collective labor agreement, which is at least equal to 1 month's salary.
On January 21, 2026, the company announced a Tet bonus plan for employees of 0.7 months' salary, paid by bank transfer on January 30, 2026.
Also according to the lawsuit, although dialogues have been organized many times between the company's Board of Directors, the Executive Committee of the grassroots Trade Union and employees, in addition to the participation of agencies, departments and the Dong Nai Provincial Labor Federation, the company still unilaterally issued a notice that the bonus level is lower than the agreement signed between the two parties.
The Executive Committee of the grassroots Trade Union has taken opinions from workers and unanimously requested competent authorities to resolve labor disputes.
