New regulations on civil servant positions

The Government assigned the Ministry of Home Affairs to advise on the promulgation of the Government's Decree regulating the position of civil servants.

In the task of deploying the action program to implement Conclusion No. 210-KL/TW of the 13th Party Central Committee on continuing to build and improve the organizational structure of the political system in the coming time, the Government requests to effectively implement the management of cadres, civil servants, and public employees.

The Ministry of Home Affairs is assigned to preside over and coordinate with ministries, ministerial-level agencies and relevant agencies and organizations to advise on the promulgation of the Government's Decree regulating job positions (VTVL) for public employees. This task is assigned by the Government to be completed in April 2026.

According to regulations, from July 1, the civil servant VTVL is regulated in the Law on Civil Servants No. 129/2025/QH15 dated December 10, 2025 of the National Assembly.

The basis for determining the VTVL of public employees includes the functions, tasks and organizational structure of public non-business units; the level of complexity, nature, characteristics, and scale of operation of public non-business units; scope, subjects of service; professional and nghiệp vụ management process.

Professional expertise and nghiệp vụ of the industry or field of professional activities and professional expertise and nghiệp vụ of other industries and fields as prescribed; the level of modernization of means, equipment, working conditions and application of science, technology, and digital transformation are also other bases for determining VTVL of civil servants.

The VTVL of civil servants includes the main contents such as the name of the VTVL; job description and capacity framework of the VTVL.

Classification of civil servant VTVL includes management VTVL; professional and nghiệp vụ VTVL; supporting VTVL.

The National Assembly assigned the Government to detail VTVL for civil servants.

Also from July 1, civil servants will be transferred to new VTVL if they meet the standards and conditions of that VTVL and the unit still needs VTVL.

The change of VTVL is decided by competent authorities, ensuring publicity, transparency, objectivity and compliance with the law.

According to the draft Decree regulating VTVL for public employees, the determination of the proportion of public employees arranged according to the professional rank of VTVL must be implemented to ensure compliance with the functions, tasks, complexity of professional activities and requirements for quality, volume, and output products.

It must be linked to the development strategy of public non-business units, the roadmap to improve the quality of staff and the requirements of innovation, creativity, and digital transformation; ensuring a reasonable balance between professional levels in each VTVL, reflecting the correct capacity structure of the staff; ensuring flexibility and adaptation to changes in task requirements.

The competent authority approving VTVL decides the proportion of public employees arranged according to the professional development level of VTVL as follows:

For public non-business units guaranteed by the state for all regular expenditures: The proportion arranged at the highest level in each VTVL used does not exceed 1/3 of the total non-business payroll assigned to the non-business unit, except for special cases decided by competent authorities.

For public non-business units that self-ensure recurrent expenditures and investment expenditures, self-ensure recurrent expenditures and partially self-ensure recurrent expenditures: The ratio is determined in accordance with the operating requirements and financial capacity of the public non-business unit, without controlling the ratio by grade.
