The total number of full-time paid days off in 2025 that employees can take off includes holidays, Tet and annual days off, accordingly:
Article 112 of the 2019 Labor Code stipulates the holidays that employees are entitled to as follows:
Holidays, Tet
1. Employees are entitled to take a day off and receive full pay during the following holidays and Tet:
a) New Year's Day: 1 day (January);
b) Lunar New Year: 5 days;
c) Victory Day: 1 day (April 30);
d) International Labor Day: 1 day (1st day of the 5th lunar month);
d) National Day: 2 days (September 2 and 1 day before or after);
e) Hung Vuong's Commemoration Day: 1 day (10th of the third lunar month).
According to the above regulations, it can be seen that the total number of holidays and Tet holidays in a year for workers is 11 days.
In addition, according to Point a, Clause 1 and 2, Article 113 of the 2019 Labor Code, it is stipulated that:
Annual holiday
1. Employees who have worked for an employer for 12 months are entitled to annual leave and receive full salary according to the labor contract as follows:
a) 12 working days for people working under normal conditions;
b) 14 working days for underage workers, disabled workers, heavy, toxic, or dangerous workers;
c) 16 working days for people working in particularly arduous, toxic, or dangerous occupations or jobs.
2. Employees who have worked for less than 12 months for an employer shall have the number of annual leave days in proportion to the number of months worked.
…
Accordingly, under normal working conditions and having worked for 12 months at the company, employees will have 12 days off with full salary.
Thus, if we add 11 days off for holidays and Tet with 12 days off per year (under normal working conditions), the total minimum number of days off that employees can take for full-time leave is: 11 + 12 = 23 days. This figure may increase according to the provisions mentioned above.
In addition, for every 5 years of work for an employer, the number of annual days off of the employee will be increased by 1 day.
In addition, Clause 1, Article 15 of the 2019 Labor Code stipulates that employees are entitled to take a personal leave while still receiving full pay and must notify the employer in the following cases:
a) Marriage: 3 days off;
b) Married children and adopted children: 1 day off;
c) Biological father, biological mother, adoptive father, adoptive mother; biological father, adoptive mother, adoptive father, adoptive mother of the wife or husband; wife or husband; biological child, adopted child: 3 days off.
