YouMe Law Firm LLC said that, based on Article 2 of Circular 08/2024/TT-BNV, there are regulations on adjusting monthly allowances as follows:
Adjusting monthly allowances
From July 1, 2024, the monthly allowance for elderly and weak commune cadres who have quit their jobs will be adjusted according to the provisions of Article 2 of Decree No. 75/2024/ND-CP dated June 30, 2024 of the Government regulating pensions, social insurance benefits and monthly allowances as follows:
1. Increase the monthly allowance by 15% above the allowance received at the time of June 2024 for subjects specified in Article 1 of this Circular.
The monthly allowance received from July 1, 2024 is calculated according to the following formula:
Monthly allowance received from July 1, 2024 = Allowance received at the time of June 2024 x 1.15.
In which: The subsidy level received in June 2024 is the subsidy level prescribed in Clause 3, Article 2 of Circular No. 11/2023/TT-BNV dated August 1, 2023 of the Minister of Home Affairs guiding the adjustment of the monthly subsidy level for cadres of old and weak communes, wards and towns who have quit their jobs.
2. From July 1, 2024, after adjusting the monthly allowance for elderly and weak commune cadres who have quit their jobs according to the provisions of Clause 1 of this Article and have a allowance level lower than VND 3,500,000/month, it will be adjusted to increase as follows:
a) Increase by VND 300,000/person/month for those with a monthly allowance level of less than VND 3,200,000/person/month;
b) Increase by 3,500,000 VND/person/month for those with a monthly allowance level from 3,200,000 VND/person/month to less than 3,500,000 VND/person/month.
3. Based on the provisions of Clauses 1 and 2 of this Article, the officials of the old commune have quit their jobs as prescribed in Article 1 of this Circular, including: former officials of the Party Committee, Chairman of the People's Committee, Deputy Secretary, Vice Chairman, Standing Committee of the Party Committee, Member of the People's Committee Secretary, People's Council Secretary of the Commune People's Council, Commune Head of the Commune Police, and the remaining titles are entitled to the month of VND 3,500,000.
The subjects applied above are the cadres of communes, wards and old towns who have been quit their monthly benefits according to Decision No. 130-CP of June 20, 1975 of the Government Council to supplement policies and remuneration for commune officials and Decision No. 111-HDBT dated October 13, 1981 of the Council of Ministers on amendments and supplements to some policies and regimes for ward officials.
Elderly commune cadres who have quit their jobs, formerly Party Committee Secretary, Chairman of the People's Committee, Deputy Secretary, Vice Chairman, Standing Member of the Party Committee, Secretary of the People's Committee, Secretary of the Commune People's Council, Commune Captain, Chief of Commune Police and other positions will receive a monthly allowance of VND 3,500,000/month from July 1, 2024.
