Pursuant to Article 15 of the Law on Property Auction 2016 (amended by Clause 10, Article 1 of the Law on Property Auction amended in 2024), the following cases are not granted an Auction Practice Certificate:
1. Not meeting the standards specified in Article 10 of this Law.
2. Current officers, professional soldiers, workers, and defense officials in agencies and units under the People's Army; officers, non-commissioned officers, officers, and technical non-commissioned officers in agencies and units under the People's Public Security; officers, civil servants, and public employees, except for civil servants and public employees, are proposed to be granted an Auction Practice Certificate to work for the Property Auction Service Center.
3. Having lost or limited civil act capacity; having difficulty in perception, mastering behavior.
4. Currently being prosecuted for criminal liability; having been sentenced and the verdict has come into legal effect; having been sentenced but not having had his criminal record cleared; having been sentenced for violating regulations on property auction activities, fraud and property appropriation, and corruption crimes, including cases where his criminal record has been cleared.
5. Currently, administrative measures are being applied to include in compulsory drug rehabilitation facilities and compulsory educational institutions according to the provisions of law on handling administrative violations.
Thus, cadres, civil servants and public employees are not granted an Auction Practice Certificate except in cases where cadres and public employees are proposed to be granted an Auction Practice Certificate to work for the Property Auction Service Center.
