Lawyer Phan Vu Tuan - Vice Chairman of the Ho Chi Minh City Intellectual Property Association (IPA HCMC) - said: "Digital transformation in the music industry is an inevitable trend for adaptation and development".
However, along with that development, the explosion of AI (artificial intelligence) and deepfake has made the detection of violations more complex, while collective rights organizations (CMOs) currently do not have enough technological capacity to monitor digital content on a global scale.
Responsibility for violations from personal or anonymous accounts is also facing many challenges. In particular, AI-generated works are currently unprotected, creating a large gap in commercial exploitation and rights division.
To solve these problems, Lawyer Phan Vu Tuan proposed promoting the application of blockchain technology and DRM (Digital content management technology) in establishing and managing intellectual property rights, while recommending perfecting the legal framework and strengthening international cooperation.
In terms of solutions, Ms. Le Nguyen Tra My, Communications Director of IPChain Company, a member of the Blockchain Association of Ho Chi Minh City, pointed out the potential of blockchain (block chain technology) and Web3 (the next generation of the Internet, built on the platform of blockchain technology and other advanced technologies) in establishing, exploiting and protecting intellectual property rights in music.
The current situation shows that 80% of artists do not own the copyright for their own works.
In 2024 alone, Vietnam recorded 79 lawsuits related to music copyright. Many works are reused and reposted on many platforms without the author's permission.
Ms. My said that in the traditional distribution model, even if a song reaches billions of listens on Spotify, the artist only receives about 20-30% of the revenue, the majority of the rest belongs to the record label and distribution platform. This reality makes many young artists feel that their creative efforts have not been recognized as worthy.
According to the representative of the Blockchain Association of Ho Chi Minh City, Web3 opens a new approach, allowing artists to proactively establish ownership, sell products directly to fans through NFT (irreplaceable notification code) and receive automatic royalties, without intermediaries.
blockchain technology can attach a unique identification code to each work, prove ownership and detect violations immediately.
However, Ms. My also frankly acknowledged that many artists are still hesitant to approach new technology because they are not familiar with digital terms.
To support artists, IPChain and the Ho Chi Minh City Blockchain Association (HBA) are implementing a process to simplify the casting and posting of NFTs, helping artists easily protect and exploit intellectual property rights proactively, transparently and legally.
copyright and intellectual property are issues of concern. Responding to the International Intellectual Property Day, the Ho Chi Minh City Department of Science and Technology has recently organized many events and seminars on the sidelines, as well as launched a video clip contest with the theme "Ho Chi Minh City students with intellectual property".
This is an activity of the city in response to Resolution No. 57-NQ/TW of the Politburo on breakthroughs in the development of science, technology, innovation and national digital transformation.
