On February 21, the leader of the People's Committee of Thuan Ha commune (Dak Song district, Dak Nong) confirmed a rare incident related to illegal marriage registration.
In April 2013, Ms. Hoa (name of characters in the news changed) was only 17 years old - not old enough to get married - and used her sister Hue's information to register her marriage with Mr. Hoang at the People's Committee of Thuan Ha commune.
The incident was not discovered, the People's Committee of the commune issued a marriage certificate to "Ms. Hue" and Mr. Hoang.
Notably, Ms. Hue later married another man, leading to the situation of her name on the two marriage certificates.
Nearly 12 years later, the incident was discovered, when Ms. Hoa and her husband completed the birth certificate registration for their third child.
At this time, Ms. Hoa wanted her name to be on the birth certificate instead of her sister's name. Therefore, the People's Committee of the commune instructed Ms. Hoa and her husband to submit a petition to the court to cancel the illegal marriage registration between Mr. Hoang and Ms. Hue.
The Dak Song District People's Court has approved. For Ms. Hoa's two first children, changing their mother's name on the birth certificate requires DNA testing.
A Justice officer - Chairman of Thuan Ha commune said that at the time of the incident, the newly established commune and the management of the records were not synchronous, leading to errors. Currently, the case has been resolved stably, without any disputes.
The relevant officials at the time of 2013 have now transferred jobs.
The incident of her younger sister taking her sister's information to register her marriage happened in 1994, in Hai Duong province. At that time, Mr. Vu Huu A and Ms. Nguyen Thi B went to the People's Committee of Van An commune, Chi Linh district (now Van An ward, Chi Linh city) to register their marriage. Because she is not yet 18 years old, Ms. B gave her sister Nguyen Thi C's name to be of marriage age. The People's Committee of Van An commune did not discover the incident, so it issued a marriage certificate to A and C.
However, Mr. A and Ms. C have no marital relationship. The person who actually married Mr. A was Ms. B. The two have lived together as husband and wife since 1994 and have two children.
The Van An Ward People's Committee's issuance of an incorrect marriage certificate has both objective factors (the person registered to declare dishonestly) and subjective factors (the officer was not careful, did not check the documents carefully).
To prevent violations of the law in marriage registration activities, the People's Procuracy of Chi Linh City recommends that the Chairman of the People's Committee of Van An Ward learn from experience and strengthen the work of checking and verifying information during the implementation of marriage registration procedures, in order to improve the quality of administrative procedures.
