On May 6, lawyer Do Ngoc Thanh - Head of the Bar Association, Ho Chi Minh City Children's Rights Protection Association - said that after receiving information about the incident and receiving a request from the victim's family, the Association sent lawyers to intervene to protect the legitimate rights and interests of children.
In an interview with Lao Dong, lawyer Thanh expressed his disagreement with the decision of the Tra On District Police Investigation Agency not to prosecute the criminal case, but determined that the victim himself died and committed the act that was dangerous to society.
According to lawyer Thanh, this determination goes against the spirit of humanity as well as the provisions of current law on child protection.
Lawyer Thanh emphasized: Children under 16 years old do not have to bear criminal responsibility for less serious or serious crimes due to intentionality, typically violations of regulations on road traffic. Therefore, combining criminal responsibility for a deceased child is inappropriate in both legal and social ly thuyet.
In particular, lawyer Thanh said that the decision not to prosecute with the reason that "the person who committed the act dangerous to society has died" was unsatisfactory and showed signs of missing out on the crime, especially in the context of many details that have not been clarified.
"Currently, the Ho Chi Minh City Association for the Protection of Children's Rights has sent 4 lawyers to provide legal support to the family of 14-year-old N.N.B.Tr in Tra On who died in a traffic accident," Mr. Thanh added.
