The Law amending and supplementing a number of articles of the Law on Officers of the Vietnam People's Army (effective from December 1, 2024) amends and supplements Clause 3 and Clause 4, Article 17 of the Law on Officers of the Vietnam People's Army as follows:
“3. The age of active officers considered for promotion from the rank of Colonel to Major General or Rear Admiral of the Navy must have at least 3 years of service remaining. In case of not having 3 years of service remaining, upon request, the President shall decide.
4. Active officers with outstanding achievements will be considered for promotion to a higher rank, but not exceeding the highest rank for the position or title the officer is holding.
The Government shall specify the criteria and standards prescribed in this clause for considering the promotion of officers of the rank of General beyond the rank. The Minister of National Defense shall specify the criteria and standards prescribed in this clause for considering the promotion of officers of the rank of Colonel and Lieutenant beyond the rank.
Previously, Article 17 of the Law on Officers of the Vietnam People's Army was amended by Clause 4, Article 1 of the Law on Officers of the Vietnam People's Army amended in 2014 (effective from July 1, 2015). In which, Clause 3 and Clause 4 stipulate as follows:
"3.The age of active officers considered for promotion from the rank of Colonel to Major General or Rear Admiral of the Navy shall not exceed 57 years, and may be higher when required by decision of the President.
4.Active officers with outstanding achievements shall be considered for promotion beyond the rank, but not exceeding the highest rank for the position or title the officer is holding."
Thus, the regulations on the age of active officers considered for promotion from the rank of Colonel to Major General and Rear Admiral of the Navy will be changed as above from December 1, 2024.
At the same time, the amended and supplemented law stipulates that the Government and the Minister of National Defense shall specify the criteria and standards for considering promotions to higher ranks for active officers with outstanding achievements in the cases prescribed.
