The Ministry of Education and Training has just issued Document No. 4798/BGDDT-NGCBQLGD to the People's Committees of provinces/cities directly under the Central Government on resolving a number of difficulties and problems of localities in the field of education and training when implementing local government at two levels.
Considering and establishing under the authority of the Commune-level Education Advisory Council
While waiting for the Government to issue a Decree to replace Decree No. 62/2020/ND-CP dated June 1, 2020 on job positions and civil servant payroll, the Ministry of Education and Training requests the People's Committees at the provincial level, within the assigned scope and authority, to proactively direct, consider, and reasonably allocate civil servant payroll at the provincial and commune levels to ensure sufficient quantity and quality;
Direct the People's Committees at the commune level to review the team of commune-level civil servants currently working at the Department of Culture and Social Affairs to ensure the arrangement of suitable people meeting the following instructions; have appropriate solutions to mobilize civil servants who have previously worked at the Department of Education and Training or receive and second education managers and teachers at all levels with appropriate expertise and experience to be arranged to the job position in charge of the education and training sector at the commune level if they meet the prescribed conditions.
Consider and establish under the authority of the Commune-level Education Advisory Council; key educational institution management groups/groups to advise and support the implementation of educational and training activities at the commune level. The participants are education managers, teachers who are working or have retired; ensure that there are no arising administrative units, organizations, etc.
Proposal to assign the Department of Education and Training to preside over the recruitment, reception, transfer, secondment, and transfer of teachers
The Ministry of Education and Training requests the Provincial People's Committee and the Chairman of the Provincial People's Committee to consider and decide on the decentralization, authorization, and assignment of the Department of Education and Training to preside over the implementation of recruitment, reception, transfer, secondment, and transfer of teachers and staff in educational institutions in the province.
For other tasks in the field of education and training, it is recommended that the Provincial People's Committee consider and assign the Department of Education and Training to preside over and advise the Provincial People's Committee and the Chairman of the Provincial People's Committee to specify the decentralization and delegation in accordance with the actual conditions of the locality, etc.
Maintain stability and ensure staff in educational institutions to prepare for the 2025-2026 school year
The Ministry of Education and Training requests the Provincial People's Committee to continue directing the implementation of teacher recruitment and solutions to ensure the staffing and staffing of preschool and general education teachers. In case the recruitment has not been carried out, it is recommended that the Provincial People's Committee consider, allocate funding and sign labor contracts or mobilize, second, and arrange inter-school and inter-level teams to ensure enough staff for the new school year.
The Provincial People's Committee is interested in and directs the timely implementation of contracts to replace cases of sick leave, maternity leave, retirement, termination of employment or contracts in the staffing quota, unused labor contract quota to ensure the supplement of teachers, staff and workers that are still lacking for educational institutions.
In addition to policies under the working regime and overtime salary payment regime for teachers and staff according to regulations, the People's Committee is interested in creating conditions for arranging facilities, reviewing and renovating public housing and support policies according to actual local conditions for teachers and staff to ensure living and working conditions for the team when implementing mobilization, secondment, inter-school and inter-level arrangement.
Continue to apply the method of calculating teachers' quotas by region as before
Regarding the implementation of zoning to calculate teacher quotas according to the provisions of Clause 1, Article 3 of Circular No. 20/2023/TT-BGDDT after implementing the arrangement of commune-level administrative units, the Ministry of Education and Training notes: Educational institutions in communes and wards after the merger continue to apply the method of calculating teacher quotas by region as before the arrangement until new instructions are available.
The implementation of the student/class quota in primary and secondary schools in special cases that require the arrangement of the number of students/class lower or higher than the regional average prescribed in Clause 2, Article 3 of Circular No. 20 shall be decided by the Provincial People's Committee to determine the number of students/class in accordance with reality (Clause 4, Article 3 of Circular No. 20.
Based on the existing conditions (faciliary conditions, staff conditions, etc.), principals of educational institutions calculate and propose to the People's Committees at the commune level the quota for students/class; The People's Committees at the commune level consider and report to the Department of Education and Training so that the Department of Education and Training can submit to the Chairman of the Provincial People's Committee to specify the number of members lower or must exceed the maximum ceiling prescribed in accordance with the actual situation of each educational institution in the area to resolve special situations arising in the process of implementing Circular No. 20.
